    Bank accounts are exempt from the CCA1974 so you cannot send a CCA request in - you basically have to blag it and continue to stop paying and hope they don't try to enforce it, otherwise you need to agree to repayments - right now, sit tight.

    yea, they will pick up the huge mistake you made - in that bank accounts are unregulated. However in future just ask before sending anything yea? We'll keep you right

      also successfully claimed Payment protection insurance back from MBNA this year (£419)
      Don't send a CCA Reminder, basically until they comply it is unenforceable and the lender cannot touch you - don't do their jobs for them, leave it to ponder and fall into default (default of your s.78 request) which means the lender is limited to what they can do.

      Just sit tight and keep us updated with this....

        As above, if you're not aware of something you certainly do not pay it do you? I think you need to sit down and ask the mrs if she has took things in your name and try and remember what you've taken out cos otherwise you'll have to make some seriously strong allegations that if incorrect, could cost you a lot. So time to stop guessing and sit down and take this serious - which right now doesn't seem the way it is. Sorry, but £15k of debt you've been paying into - that you don't think is yours? Over 2 accounts? Come on, that really isn't the sensible thing to do now is it?

        However, my next question will sort it all in one swift move - have you applied for your credit files? I need you to check both Experian and Equifax which will tell you the date last paid, whether defaulted and most importantly it will show the live accounts listed there by lenders!

          Just keep us updated when they respond and STOP sending the CCA chaser - we do not use that!

            The templates here become "unlocked" the more posts you make. Things have changed from MSE days as have some elements of the Act and associated laws so be careful what you do/send etc.... run it by us on here and stop stressing. I am really busy and sometimes do not check emails for a week at a time so bear with me.

            Thanks - you have a lot to be getting on with such as investigating your credit file to find out what these erroneous accounts with Barcvlays are (for a start) then edit each above post and add the correct info.

              I've been a while but busy changing jobs and preparing to move.

              So far, no answers apart from the barclaycard and the GE capital. However, with the site move, i cannot find the letters you put on the link.

              They haven't come back to me on any other credit agreement. It's now been over two months...Let's see

                          They do - hover with your mouse and it goes orange...... I usually make them bold as well, so they stand out

                              Hi Niddy,

                              I've replied on the Barclaycard with the missing prescribed terms about ten days ago. I just need to check the date.

                              Since I was late on the GE one, I haven't done anything.

                              They sent me a letter last years saying the whole account was on hold (after I asked for all CCA's). Now they're sending me a letter offering a rebate on a settlement. I've just ignored that as as far as I'm concerned, they still haven't provided any CCA bar the GE one.

                              What do you suggest next? WHat shall I do about the Barclaycard one once the 12 working days have expired?

                                Hi delacroix.

                                The way we work is more reactive than proactive. What I mean by that, is that if we get threatening letters, we react to them. We don't actively communicate with lenders / DCA's to chase them up.

                                We know that they have had our letters, (it is best to keep a copy of all correspondence sent, and staple the recorded delivery receipt to the letter, so you can prove it was sent - I have a file for each lender with my response attached to their letters) so until such a time they provide a legally binding CCA, then the agreement is considered unenforceable, and we stop paying them and get on with our lives.

                                Chasing them up does you no favours, so don't panic if they don't reply, just forget about it until you hear from them. If they start threatening you, or if they sell the debt to someone else, then you update your thread with what has happened and we (niddy usually!) give you advice on what to do.
