I have had a lengthy reply from the BH, and I will upload it later. Its very lengthy and I need get my head around it..Basically they are refuting any responsibility.I signed... end of... and they say they are not responsible for what went on with my ex and the salesman

Is there a time limit in which I could go back to the dealer who consorted with my ex over the sale and exchange of the vehicles? Or am I wasting my time there ?

I don t know about a diary ,,, I rather think my problem is more of a shafted saga...if there is such a thing... Thanks to this site and the help I have recieved from people who have been/experienced debt problems I am able to cope much better.

I have followed some of the diaries and its obvious that these debt issues grow out of greed and unfeeling on the part of the banks and lenders. A lot is irresponsible lending as in my case, and the greed allows mistakes to be made. So now, I am thinking.. I have paid way past what the vehicle was worth in money and emotion If the lenders were more sympathetic to issues like divorce, death and illness, and not so greedy and ill feeling maybe they may get somewhere, we are not in debt by choice.

Thanks to the support, I think now what the heck , what can they do ? I am retired now and do not have the money to throw at BH for something I never used, or wanted and have more than paid for now. All I wanted at the time was a home for me and my children, rebuild my life and theirs. I was "shafted" by my ex, the sales people , BH solicitors and barristers. NO MORE!!

I look for similar cases on here, but mine don t seem like any but bits of many other problems, so I pick away at the valuable info.
I am waiting for my partner to arrive with the lengthy explanation from the BH, saying that I signed and have to pay, but they are kindly giving me a payment without prejudice amount, and they are within their rights to assign the debt to a DCA !!!

Whats that all about? Why do they have to assign it to a set of bullyboys?
Surely a bank has some responsibility, when writing cheques for thousands of pounds?
Surely there is some communication between the lender and the company selling the goods?

I have had my vent now, so its coffee time and think of my next step in the saga... thanks again for a haven of a site.

Thats what I am starting to think, it sorts of admits a defeat on their part?

The funny thing with my case is, that it was assigned to Nationwide dca in the early stages when I got into serious debt , and it was sorted inasmuch as I started paying £30 then £40 then £50 per month. I then retired and my partner started looking at the debt and discovered numerous inaccuracies , so I stopped paying and the letters started coming from the BH again.

Its good to read on here and know you are not alone,

BH cannot provide me so far with a proper agreement or document illustrating the price of the motorhome, reference to part exchange, the equity on the car and the caravan , deposit and vat charges.

The car and caravan were mine and sold to the dealer by my ex, I had no notification of prices and equity, I have an invoice to that affect. ( recently discovered)

The amount payable ranges from £10,500 to £28,000 on the final agreement ( which I did sign) with no illustration as to this amount is made up.

Hindsight , yes I was stupid , naive, but also in a bad place with no home, an injunction on my ex, 2 teenagers hanging onto me, a job I could n t go to because I had no clothes as such etc etc neither had the girls. My ex said he would screw me (financially) if I left him, and he did it seems but I am in a better place now and he isn t, and I don t see why I should throw any more of my hard earned cash at this debt.

I think you are right i noticed that when i sent off for cca requests one original creditor didn't know what i was requesting and kept sending me letters saying they couldn't pay into that loan account when it was a credit card . I have a loan with Black Horse and the agreement is unenforceable because of an arrangement fee. I have the original agreement but i never noticed it before and when i sent it to niddy he said its ue because it should have seperate pt's .

Have you got the original agreement ? if so check for arrangement fees .

Keep smiling your getting there and the courage you have is good to see.

I think sometimes the problem is the creditor who ever it is doesnt realise that they have done something that has finally made the metophorical worm turn.

I know what ours was. OH out of work I was trying to support life and pay down what these leeches were demanding. It was struggle we were both losing and it was making us unhappy.

For us it was APEX. OH was on the dole and they ring up demanding more. She was, well through me paying £70pcm. They got her to up it to £75. I know we werent on good terms that night. For a measly £5 when we were on our asses they were destroying us.

I went onto the net through despair. Found MSE first then CAG then here.

Now we are assertive and the wheel is turning. Some will get the money some will get some and some will get none. But all on our terms now.

But this all stems from a DCA demanding when you cant. That DCA is now in big trouble as they are having difficulty obtaining the CCA and are getting diddly squat off us now.

That day they could have rung up hello oh my you on the dole sorry we need to reshedule and no dont worry let us know when you back in and till them £1 a month will do.

Do you know what if they had we would have paid it all back. They forced us here. And BH by being greedy has done the same.

I have the original agreement that I signed. all it has is the total amount and interest and there is a charge of sorts on it so I will check. Cos on the 2 nd customer copy which is nt a true copy, the figures are slightly different. A copy should be just that .... a copy, ..... but don t think that they have answered that question. Their argument is my signature to agree to the finance !!

But I will go and check, thanks....


They also keep going on about it being unregulated as if that gives them "carte Blanche" to do whatever....

Not ready to give up yet.... if ever !!!

Thanks Ken, Know exactly where you re coming from.. a bit of understanding on their part would get them more, and maybe fewer mistakes... passing from one department to another, one dca to another .... over time things must get confused.

I signed out of desperation and bad advice from people who should know better, Don Adalot knew we had problems and kept pestering for a sale, which my ex encouraged and it was done with no consultation to me, except to say sign and I give you the home back... also through solicitors... and by then I had whacking big debts to pay off and needed to sell the house and get my life back.

I tried complaining later to Ombudsmen...CAB... solicitor advice but all were brick walls.. Nationwide were vile ... so I just paid, and they keep pushing up the anti.. well I aint got any now.. not for them anyway

What was upsetting too was the report from a private investigator when the BH were seeking the whereabouts of the motorhome, totaly made up description of events and me and they had downloaded copies of my home ready to take me to court I presume, or find where I was... vile people

And for all the people out there who sustain this system they are only one life event for it happen to them.

The industry is a law unto itself but is allowed to work like this because the establishment get revenue from it all.

Regulators are kept weak just as a facade to make it look good.

Self help is the way to do this with mutual support

My boyfriend will be bringing it over Thursday, so I will scan it for you, it is lengthy as he read it to me over the phone. I could email it if you wish but I suppose it would be good info on here My boyfriend stepped in as a go between for me as I was n t coping too well with it all. They are not too sure of him like they were of me...
