Ok..... leave this one with me and I'll draft up a formal complaint letter over the next day or so for you to look at.

Was your initial complaint actually headed up as a "complaint"? Have you still got a copy of this letter?

• Why is there a difference between the two agreements on the balance to pay? £17,500.00 is unaccountable between the sales invoice and your agreement? Would you explain this please?

This seems to be the burning question.... and BH need to account for it

Thank you for your reply and statement of account. I am writing now to clarify my complaint to Black Horse.

1) The only agreement I have ever received from Black Horse is the one enclosed. It is barely legible and records no mention of the part exchange deal of a Kia Sportage and caravan.
2) No interest rates are shown which surely is statutory? So how is my debt being calculated? The signed copy and customer 2nd copy do not agree, could you ex plain why?
3) I have never received any statements over the period of this debt, apart from one dated 2nd December 2004 and 22nd November 2011.My local Black Horse manager informed me that this is a legal requirement?
4) I have never received a payment plan since the CAB became involved. I have only ever received letters indicating a temporary arrangement over 3 or 6 month, but never with any due dates or any other information. Therefore, how could it be said to be overdue or owing or anything else? How do you calculate the amounts?
5) More recently, I have started receiving letters from Black Horse. It was originally passed to Nationwide Collection Services. I asked why the changes? Who is dealing with this account, why is it passing from one to the other with no letter of advice to me?
6) According to the copy of the original agreement the deal was for £28,000 over 10 years. The loan then amounted to £40094.35 to be repaid over the ten year period. There has appeared an invoice signed by my ex husband indicating the balance due was only £10,500 , can you explain this?
7) The above invoice and part exchange was signed by my ex husband, I had no notification of this transaction, and both the car and caravan were in my name and not his. Can you explain this please?
8) I was involved with a complicated expensive divorce, left with 2 teenage daughters and a large debt. Consequently the motor home which my ex had taken was repossessed. I went to the CAB for help and I presumed that they had sorted the debt out. I was told there was a reduction in the interest and charges and yet these do not seem to be recorded. Can you explain this?

9) The motor home was repossessed and sold for £19400.25 I was informed over the phone yet received no receipt for this.
10) I cashed in an endowment policy (awarded by the courts to finance my children in their home) , because I was under threat of Black Horse taking me to court and applying an order against my home.( I was at breaking point by now).A further £9000.00 was paid to Black Horse. I had already paid 11 DD payments amounting to £3669.93.
11) Therefore over a period of 28 months I had repaid £32130.18 of the original debt.No allowance was given to me for this early repayment, why not?
12) In 28 months I had repaid the capital of £28000.00 plus £4130.18 interest in the first 28 months of the 10 year loan period. Which, if I refer you back to point 6 is wrongly calculated!!
13) Since CAB negotiated between Black Horse and myself I have paid a further £3530.00 in smaller repayments and in regular monthly intervals.
ie. 19 x £30 1 x £10 52 x £40 17 x £50 4 x £5


14) My main complaint is that on a deal of £28.000.00 (where no interest is shown) I repaid the capital over 28 months and £4130.18 of interest charges , then a further period of repayments amounting to £3530.00 . This brings the total to £35660.18

I have consulted a financial advisor who believes that this whole issue is showing too many irregular discrepancies. The original debt was more than repaid early and yet no early settlement figure is offered. I too believe that I have more than repaid the debt. Black Horse has not treated me fairly, and has allowed me to be pressurised and harassed when I have done my best to repay this loan over the past ten years. A debt that was not incurred by me willingly may I add. I am now being harassed by two different departments of Black Horse constantly even though I am keeping in contact through letters and a cheque each month to show I want this issue to be resolved.

I am looking to have this loan cleared by you in light of the issues I have listed, and an apology for the way it has been handled which has caused me a lot of stress over the years. I am shortly to retire and it’s for that reason I have enlisted the help of a friend who has looked into this debt for me. He can be contacted on > I have already noted this to yourselves as I still find this issue very upsetting.

If we cannot come to any agreement then I will be quite happy to let the Financial Ombudsman make the final decision.

Rather long but we had to list everything for the FO to take a look at my complaint. I sent this to the complaints dept at BH,

They ignored it as they do and just sent me the usual copies of agreements and a statement and £25... from there I have done as I stated above. and concentrated on the main issue of the missing amount

Ok.... here we go. This is a bit of a diatribe and will hopefully give them a headache. Please check for accuracy and fill in the gaps marked with an x. Apologies for any obvious mistakes' it's often difficult to put yourself in someone else's shoes when constructing a letter like this though....

When you are happy, it must go off by rec. delivery to Black Horse, with a copy to their Head Office also by rec. delivery. You may also want to consider cancelling any current payment arrangement (as mentioned in the letter) to let them know you're serious.

Anyone please feel free to comment/criticise before it goes off.....


SECOND FORMAL COMPLAINT

Dear Sir/Madam,

Your Ref: xxxxxxxxxx

I refer to your response to my request under the Data Protection Act; made on xx/xx/xx. I also refer to your response to my first formal complaint, which lacks any real attempt to address the concerns raised therein.

For your ease of reference, I will now re-direct you to those concerns and suggest that you re-acquaint yourself properly with the points raised this time, as I will be requiring a full and detailed response to each and every one of these points (below) under the Consumer Protection from Unfair Trading Regulations (CPUTR) 2008.

a). The only paperwork ever received from Black Horse Finance is not only barely legible but lacks any details regarding the part exchange deal of a Kia Sportage and caravan on xx/xx/xx. I therefore require full details of the part-exchange deal that took place around this time and/or a full explanation as to why you appear to have no trace of it.

b). According to the copy documentation I have in my possession, the deal was for an amount of £28,000 over 10 years and the subsequent loan amounted to £40,094.35 to be paid over a ten year period. I therefore require a full explanation regarding the invoice bearing my ex-husband’s signature indicating a balance of £10,500.

c). I also require a full explanation as to what exactly this paperwork represents anyway; since it appears to lack any key information regarding interest rates and/or terms and conditions. I therefore require full details of the interest rate(s) that you have been charging to the account since its inception.

d). I also require a full explanation as to the precise manner in which you have calculated interest on this account since inception, since no interest rates are shown on the documentation you have provided.

e). I also require a full breakdown of all fees and charges added to the account since that time; either by Black Horse Finance or any agents you may have instructed to act on your behalf, including precise details of what these fees and/or charges were for.

f). The signed paperwork and the customer copy do not agree, I therefore require a full explanation of how you deem it to be a “copy” since by definition, a copy is a replica and should look exactly the same.

g). I also require a full explanation as to why an invoice and part-exchange signed by my ex-husband was even accepted by Black Horse Finance in the first place, when neither the car or the caravan were ever in his name.

h). As the caravan was eventually repossessed and sold for a sum of £19,400.25. I also require a full explanation as to why I was never provided with a receipt for this transaction.

i). I also require a full explanation as to why no Statements of Account have been sent to me since 2002, apart from one statement in 2004 and one in 2011.

j). I also require a full explanation as to where these Statements of Account are and the reason they were not sent to me as part of my request under the Data Protection Act. If you find that you do not in fact hold any such records pertaining to myself, I require a full breakdown of the manner in which they were destroyed, precisely when they were destroyed and, the reason for their disposal.

k). Over a period of 28 months, I repaid £32,130.18 of an incorrectly calculated loan (based on dubious “copy” documents) to your company; £28,000.00 plus £4130.18 interest. I require a full explanation as to why such discrepancies were ever allowed to happen and why it/they continued unchecked by a company like yourselves, who should have got it right in the first place.

l). Since Citizen’s Advice Bureau negotiated between your company and myself, I have also paid a further £3,530.00 in smaller repayments and in regular monthly intervals since; amounting to a grand total of £35,660.18. I now require a full explanation as to how your company has the audacity to keep hounding me for money when the whole sorry saga is riddled with discrepancies like the ones outlined above.

I accept that the content of this second formal complaint is lengthy and expect that it will take your company some time to address all of the concerns raised within it. I must stress however that I am not prepared to communicate with anyone over the telephone and expect your company to put an end to the constant stream of harassment that I am currently experiencing from two of your departments and from one of your agents

Please be aware that as a legitimate dispute has now been raised courtesy of a second formal complaint and that responses to each point are requested in writing under the Consumer Protection from Unfair Trading Regulations (CPUTR) 2008, that no further payments will be forthcoming at this time. Should it be your intention to pursue this matter through the courts however, any action you may decide to take will be vigorously defended by way of but not limited to, the points raised within this second formal complaint.

In light of the issues raised and the plethora of discrepancies that have occurred over the years, I now request that the remainder of any alleged debt be written off in its entirety by your company. This means that any alleged balance must not be passed or sold to another company but closed completely.

I await your considered response.
