I v just received my SAR reply, and there is nothing new in the envelope>>> I was hoping for more information regarding the repossession and part exchange deal. Answers to my questions regarding the finance deal and the irregular calculation of the figures.

There are copies of letters, report from the balliff, agreements not related to the vehicle, screen shots etc etc

Can anyone explain just exactly what I should expect in this envelope. Please. ??

I v had acknowledgement from FLA and a solicitor friend has calculated the payments etc and says they are incorrect, so thats one thing to go at. I v enlisted a close friend to deal with BH as everytime I get out the papers I just feel sick.. Ten years and it still affects me, especially when I see his signature on part of the deal. This says taking the car and caravan in part ex, leaves a balance of £10,500 !!

This just blows my mind and makes me choke!! This is a recently discovered part of the deal, and BH also have a copy (it was in the SAR) It opens a big can of worms for me and not sure how to deal with it, so enlisting help.

1. Big difference between the £40.000 i m being harrassed for.
2. I was led to believe (bearing in mind I was homeless at the time and under great stress to sign, to the point of being on medication) that there was no equity in the car and caravan. So where did the difference come from?
3. The car and caravan agreements were in my name and I don t think he had the right to sign for the part ex deal.

Just thought you would like update, this is ten years old now... I was always lead to believe big companies were right, slick, never made mistakes.. Seems quite the contrary now I m older and getting wiser.

Anything that helps you put up enough of a fight, so if you have other details and/or things in there that is not relevant to you then that is good and offers some defence, so you need to check it and check it again and find errors.

By errors I mean anything that is untoward/sketchy etc.....

I am a home owner, and sketchy is right. We have asked for details of the auction and details of the part exchange. The motorhome was part exed against a car and caravan, both in my name. The deal was signed by my ex (I had no dealings with this and only found a copy of this recently) The balance due does not correspond to the amount I signed to borrow, .

There is no mention of the part ex on the agreement.

We have gone over the statements and they do not balance either.

So ... see what they reply to that, there are other errors, but I just feel I was taken for a ride at the time as I was under a lot of stress and also feel there could of been something underhand with the part exchange.

Had a reply from the FLA that they are looking at it...

I just worry that they can take off me what I have worked hard for,

Not heard anything yet, but I am still bothered about the agreement I found in some solicitor paperwork.....can a husband sign for the sale of a wife s property? that is a car and caravan financed and purchased in her name..... is it legal ?

No a husband cannot sell something that's not in his name. Unless you authorised him.

Well !!!! I don t know whether to cry, be angry depressed sick or what !!

I recieved a reply from the FLA.....What a waste of time that was.... they are all a load of *******and these "associations! are just jobs for the boys for what use they are. I think to relieve the pressure and stress in my head I will have to reply !!

All they have done is to write (or phone) the BH who have replied that they answered my complaint back in January this year , that they have repaid some of the arrears costs and as far as they are concerned there is no more case to answer.

The FLA say that the issue is at a deadlock and they can do no more mediation!! They are very sorry and suggest I consult a legal person.

What a load of *** > thats not mediating ... its writing a letter and agreeing with the BH, they have completely missed the point of what I am complaining about and I shall tell them so.

I detailed the complaint to the BH and sent the same to the FLA, none of my questions have been answered

The BH and their agent Don Amott Leisure... sold my car and caravan without consulting me and with my ex husbands signature agreeing to the deal.
The money that was left over, I never received and cannot find where it went, probably someones back pocket
The part exchange was not carried over to the sale of the motorhome, and I was told there was no equity, bearing in mind I was in no fit state at the time, Consequently I took on finance for the whole amount.
The customer copy and 2nd copy of the agreement do not agree with the figures.
The motorhome was repossessed and BH cannot locate the receipt from the Measham Auction to prove how much it went for
The BH after 23 months had recieved the biggest part of that loan if I add up the auction price, my monthly payments, and lump sum payment I sent to them to keep it out of court. (wish I had of gone now) This amount more than covered the cost of the vehicle

And the FLA say all this is ok !!!! they just can t be arsed to mediate as the meaning of the word implies, a load of to******

I think being angry is the best mood, as otherwise Bargain Booze sales will go up and I cant afford that lol...I think with this site full of information,and assistance, together with my friend who worked in finance and his friend a solicitor, I shall have to go it alone, these associations are a waste of time.....

Further update, been to see a solicitor friend who has taken a proper look at what I have and it is looking like fraud on the part of my ex and the dealership....

We are going to ask questions but if I can get them to give up, acknowledge the balance is unenforceable I will settle for that,

The information on here is so helpful, The SAR helped us to find bits of info, so I will let you all know how it goes, any comments will be good.

I am looking to ask BH about the figures but really its the dealership that concocted the agreement, but I would like to know how close they work, how responsible are the dealer and the finance company to me and each other.....

Does anyone have any experiences of Moorcroft Debt Recovery Ltd?

I or we have sent letters to BH requesting more evidence/details of the alleged amount that I owe. There are big discrepancies , and we have had no explainations. They have answered by sending my account to Moorcroft DCA who threaten to advise BH to take me to court if I don t sent them some money.

I have read enough on here ( and with my b f support too) to take a deep breath before I panic and react like I have done in the past.

So can anyone relate to these people ? I want answers surely before I send money?
