Few points that stand out here but main ones are:

1. It's unregulated hence s.78 does not apply;
2. They have added an acceptance fee and another fee, these should be separate under s.18 but this is not regulated lets not forget;
3. Is that your signature on the second page (signed_copy.bmp)
4. Have you considered arguing under The Unfair Terms in Consumer Contracts Regulations 1999?

Are they actually taking legal action, have they taken legal action and do they have a CCJ or CO against you?

The signature is mine, The one for the vehicle trade in is my ex s.

They took legal action when they repossessed the vehicle. They threatened me with court action which is why I cashed in an endownment policy to pay a further £9k. At the moment they are continually calling and writing to me. They held off when I went to the FO, but now thats not an option they are contacting me again and threatening me with extra charges to my account and against my credit reference. There are 2 different departments in the BH doing this.

I ll go to look at the unfair terms but not sure what that is.

Iv read the unfair terms but I m not too clear on their meaning to me.... I never had an official type of agreement after the vehicle was repossessed. The CAB negotiated with them and this resulted in me sending £30 per month. They still pestered me and called it a temporary agreement for 6 or 3 months.

I have had a reply to my request for CCA from the Black Horse.
To recap. my debt has lots of errors how I see it. Its ten years old for £40 k and deemed unregulated by the FO.
The BH have sent me an up to date statement and thats it!!

I was expecting some more paperwork but to be honest I don t really understand what unregulated means to me and my problem. And no one else seems to either !! BH don t seem to be able to answer my questions, or don t want to .

Anyway, I have sent the issue to the FLA so it will be interesting to see what they make of it all, and until I have answers I am not paying them any more money.

I welcome comments from you folk on here if you have a moment.

Iv had more info today from BH. My problem is complex and unusual I think , but I am learning things on here. It was interesting to see what BH would send me and they just searched for finance I d had off them for years back. They did send me a settlement deal on the caravan which I had never seen.
I was wanting to see information surrounding the repo of the motor home also more info on the trade in , but nothing doing. Niddy is right I have been shafted in the not so nice sense of the word.

However, I am still trying to understand the relevance and meaning of my unregulated agreement of 2002.

Can someone tell me how trade in deals work out.My ex signed for the trade ins which he did not own? Also the trade in never showed on the loan agreement...I signed for a £40k loan on a vehicle which was £28k. The car and the caravan sort of disappeared yet there must of been some equity on them. for example, I have an invoice for the car for £6k which I purchased 2 years previous, yet the trade in was for £6k, cars do n t increase in price and there was 2 years payments.

My question is, should n t the trade in s be shown on the final agreement? Was it lawful that my ex signed for the trade in , and I was not party to any of that even though they were mine?

I have put all this to the FLA, but now I have been made to look at it all again, I can t understand how I could of been so naive, but, that was another time,

Oh and another question please, I am trying to gain as much information as I can from the BH , following reading on here. I sent a CCA letter even though Niddy said it was irrelevant I d already sent it.

What would I expect to get back? I v had signed agreements and statements.

Should I expected to get receipts or invoices for the repossession?

Should the interest rate be written on the agreement?

Should the part exchange information be written on the agreement, even if there was ( so they might make out ) not equity, and should there not be proof of the same?

No, but I am going to. I was hoping to get a bit more than I did asking for CCA. They dragged out credit agreements long since paid, apart from the one on the caravan which was interesting.

I am just reading up your info on unenforceability, this is such a complicated mess and been passed around numerous departments over 10 years. Added to the shifty shafting I think my ex and salesman did, maybe I will be able to do a damage limitation on it now I have faced up to it all. I shall send the advanced request so that I don t just get agreement copies and statements again. I want info on the trade in , the auction and repossession and more.

I will wait awhile though to see what happens with the FLA.

My partner has rung the call centre to tell them I no longer own that number and they are deleting it , so maybe I can switch my phone on again soon, I think that is such an imposition on peoples privacy ..

I m back, I v just had a letter threatening me with court action if I don t pay or contact them in ten days.
I know my problem is n t as serious as others here, and does seem to be quirky. So I m checking for things that can help.
Just re read the comment "is it under the CCA of 74" So went back to agreement it says "unregulated hire purchase -fixed rate." but on the back in the T&C it quotes sections from this Act,
Does this mean that I take it that it is covered by the Consumer Act?
Im waiting on a reply from FLA and meanwhile have sent an SAR for details and answers to my questions..

Makes me feel sick in the stomach as now I m retired I have limited income.... although I think court proceedings may be the only way to end this nightmare... thanks

Try not to worry, as you say maybe a day in court wouldn't be such a bad thing, but really await a response to your SAR and FLA.....
