I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website. I am extremely busy so if you do contact me or need a reply to a forum post then use the email or PM features offered because I do miss things and get tied up for days at a time!
If you spot any spammers, AE's, abusive or libellous posts or anything else that just doesn't feel right then please report them to me as soon as you spot them at: webmaster@all-about-debt.co.uk

Another couple of emails received from TMLEGAL both stating we haven’t come to an amicable agreement to repay the CCJ and outlining methods of enforcement. Also offering a reduced settlement figures. On another note the FOS have dismissed our claim against the original lender for irresponsible lending for the first two loans taken but require further information as to the third (and largest) loan which makes up the bulk of what TM are claiming as they feel the original lender should have made further checks before agreeing the loan. So fingers crossed

Were your two complaints to the FOS (which haven't been upheld) at the Adjudicator's stage or had they been escalated to an Ombudsman for a Decision?

The Adjudicator should have explained why they weren't upholding your complaint, so see if you can come up with any further evidence to change his/her mind (counter the argument they've given you) and then escalate it to an Ombudsman.

No they can't obtain an AOE without first getting a CCJ.
(I need to read back through your thread to see why you are 100% certain there wasn't a CCJ in July.)
They also can't get a AOE if you're self employed - are you or your wife if this is her debt?

So an email has now been received from Asset Collection in response to the complaint issued to them. They now state they hold the account and are giving 14 days for us to contact them before they consider their next course of action. I have already informed them in my complaint that the FOS are currently looking at the complaint, which Asset haven’t even acknowledged in their response and it appears they are still not contacting TMLEGAL to stop their enforcement action. In my complaint to them I also requested all relevant documents CCA , assignment notices etc but none of this has been received or acknowledged. I sent everything to them special delivery and have proof of postage etc. Any advice at this stage? I know advice is usually to await their next move but I feel there is so much on going on this account but feel I need to at least reiterate FOS involvement so account can be put on hold. Thank in advance
