      Received a final response to my CUPTR complaint.

      Basically, they say that they consider any complaints regarding the CCA they sent as closed as per a previous complaint response and to take to FOS if not happy.

      Looks like a fobbing off to me as it never came with the SAR either and they are basically ignoring the question.

        Remember that you only have 6 months from the date of their final response to go to the FOS.

          Yeah...done that a few times with pretty good results.

          In this case, I'm wondering what I could hope to gain apart from any referral fee they have to pay.

          Any ideas?

            They do not normally reply to CPUTR request, you are trying to get them to admit UE. Ombudsman may help, but don't bet on it.

              Surely under OFT guidelines, they are not supposed to mislead you?

              In any case, lack of inclusion with SAR should be conclusive.

              I will refer to FOS, for the fee and wondering what they will do more than anything.

              Will report back when the FOS reply, after a few months on this I expect...

                They don't want to put anything in writing..... They're not misleading you; they just don't want to talk to you. It's now down to you to read between the lines and assume that what they have is UE. This kind of response is very common.

                Personally, I wouldn't bother with the FOS.... just wait and see what you get next.

                My bet is it will either go back to the OC or be passed on to someone else....

                  OFT Guidelines are just as stated. Guidelines. Don't expect the banks to adhere to them, they don't. Our current system of banking is completely unregulated. The FOS cannot help in many situations as they do not have a remit on the enforceability of agreements. As I stated, the system of banking is completely unregulated. The Financial Conduct Authority are looking to change the system from next year. Fingers crossed.

                    Hi folks,

                    Just got a letter from RBS saying they have passed the account to Allied Credit International (UK) for collection as I haven't contacted RBS to pay.

                    They will be in touch within 14 days to arrange repayment options.

                    So, I'm presuming they are collecting on behalf of.

                    When they write, should I ignore them or CCA them, even though its UE and RBS have issued a final complaint response to the issue of the CCA being incorrect in many respects.

                      When they write, send them the account sold in dispute template.

                          They're so predictable....

                          I'd be inclined to refer them back to their "clients" and state that you're still waiting for a response to a request made under CPUTR (2008) on ??/??/?? and until such times as RBS are able to address the concerns raised within that letter, no payments will be forthcoming to anyone for anything.

                            Received a letter from AIC acting on behalf of RBS stating that it would be in my interest to come to a payment arrangement and included an income expenditure form.

                            In MY interest? I wonder how they work that out!

                                Hi all

                                quick update.

                                Proud owner of a letter from AIC offering early settlement spread over a few months. Email or call for figure. Yeah right.....still gonna be several k. And it's still UE.

                                If not we will review your file or further action blah blah...

                                I would presume RBS must be thinking of selling this soon.

                                out of interest, does emailing count as acknowledging debt in writing?
