    On the contrary Jon, a paper trail is often a very good thing to have. I doubt this one would end up in court anyway.

        with regards to paying them on arrangement, it really does help them drag everything out - is this what you want?
        It took me a night of reading AAD posts but eventually it sunk in: once they default you, it provides the option for you to take control of the situation because they may have very little else (or anything at all ) to use against you.
        Once you stop all payments it forces the situation to sort itself out - this may be a settlement if its legit, or letter table tennis if it isn't!
        If it is legit, the money you will save from not paying them can be used in a settlement before it turns naughty (if it ever did).
        As for the banks, i remember sitting in my car at lunchtime (because i didnt want anyone in the work canteen to overhear) and the conversation with Barclays when i was on the bones of my arse pleading with them. I will never forget i eventually spoke with someone who could actually comprehend what i was talking about. Their answer was: "as long as you continue to pay the agreed amount there is nothing we can do. If you are paying us and don't have the money for food, or central heating - that's your choice."
        When Gold isn't enough, there is SA Gold! New to the forum and find the UE route a bit scary? Take a look at my diary here and judge for yourself. I am now saving the money each month that was making little difference to the balance and not a bit of difference to my credit file as a result of finding AAD.

          If/when you stop paying, Triton will eventually send this back to the OC because they don't own it. They'll then send it to another bunch to try and get money out of you.....

          It would be far easier for them to just send a copy of your CCA but since it doesn't look look they have it, all they can do is pressure you into continuing payments on the back of an application/recon.... and while letter tennis may seem like a pain in the rear, it's well worth doing if it saves you money. Letter tennis is also a good strategy for letting creditors know that you're not taking any of their b*llocks and in my experience, has been a tried and trusted method of staying out of court altogether.

            Thanks for the reply.

            I agree with you. Originally defaulted to stop high interest rate which was rate jacked on an existing balance before the rules stopped it.

            I can afford now to pay it, but they have had their share and are being arsey so I won't pay them a penny for now. Lying about the CCA isn't inspiring me to pay either.

            Luckily I spent a fair bit of time on MSE, so know what they can and can't do, roughly. The UE thing is new though for accounts like this.

            No bank has my number ad I complain at the first chance of taking the piss so thinking can del with this ok with our guys expert help.

            I feel really sorry for people in circumstances you describe, banks really don't care.

            Will update my UE diary at some point as there are a few accounts I feel like this about.

                  Capital One in house Monkeys on the phone few years ago, we may be able to come to an agreement and set up a monthly figure, but you must make a payment to-day, I said after all the (iffs and buts), well I only have heating allowance which arrived to-day, (I was recovering from Heart attack at the time, and greatly reduced hours at work) so I payed them £132 over the phone and happen to mention that that is most of the pensioners annual heating allowance, all I heard was a loud laugh, so I left the phone, started to pay a smaller amount best I could, had letter stating that an agreed £50 per month is the agreement yet on the phone it was a larger amount stated, so that was it I sent off CCA1974 request etc and ignored their demands from then on, bastards.

                    Agree with you. Crap one only had a prospective, future regulated agreement. Made my life hell. Then I came to my senses, now pay them now't. Been through all their constant phone calls, different DCA's etc. All quiet on the western front for last 18 months.

                      Pleased to hear you've started your own diary.
                      When you say you can "afford to" - personally, i am saving the money i was spending with these pirates and not touching it. I've got an enforceable one so hopefully when it does go sour (they haven't had a penny for 8 months ) i'll have money put aside to barter with them.

                        You're unlikely to get a direct response to your letter..... which will "confirm" what you need to know anyway in a roundabout kind of way.

                                Hi folks,

                                Quick update.

                                Not paid anything to Triton for a couple of Months now. Got a few letters all very dull and one from Greens solicitors (Part of RBS Group) full of mights and maybes that we/someone might/may take you to court blah...

                                Sent a CUPTR request to see what they had to say about copies of the original agreement. Response was basically thanks for your CCA request, you forgot your £1....WTF?

                                Submitted written complaint basically telling them to stop taking the proverbial as its clearly not a CCA request...

                                I await a response...and yes I know I might be wasting the odd stamp, but it gets their complaint numbers up and gives me some amusement at their comedy responses
