    Hi all,

    Update on this.

    Triton pretend they are not part of RBS despite having a footer saying they are owned by RBS. Sigh...

    They are Refusing my offer of £100 per month as they can't confirm whether or not the offer is affordable for me and as a responsible creditor...blah. Never stopped them cashing the last 2 cheques though. They want my I and E I reckon and they can shove it...

    Told them as much in a letter and said that they will presumably be returning the last 2 payments as they can't confirm I can afford to make them.

    Also sent them a CUPTR letter to see if they do have my original CCA but I doubt they do.

    Thanks for the help so far. Will update when I get something back.

      why pay £100pm when they can't supply a CCA

      I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website. I am extremely busy so if you do contact me or need a reply to a forum post then use the email or PM features offered because I do miss things and get tied up for days at a time!

        Erm, partially moral, to a point. Not at all rich

        Just thought they might have not being arsed to dig out the original if in storage and sent a badly reconstructed one knowing they had t original. Although you might be right, as for the OH they sent a signed application form, loads of reconstituted drivel like I got. So if they can find the application form then it would be easier to copy the CCA also rather than ave to make shit up.

        I don't currently have the funds to pay in its entirety if they do have the means to take to court. I do for some smaller debts so willing to risk these as if it was to get to court I could pay it.

          I hope you're going to stop paying them. We've all had the "moral" argument with ourselves but ask yourself...are the lenders acting morally?

            If they had the original stored somewhere they would supply it, they dont send reconstituted agreements because they are lazy, they send them when they dont have the original.

            If your worried about court, forgetting for a second that you have plenty of cards to play before it got serious if you wanted to use them, your defence would be quite straight forward, unable to obtain judgement due to unsatisfied CCA request.

            Please dont read to much in to what they do, all of us here are expierenced enough to know when they are talking rubbish, and when they are not.

            Morality is not an issue, as you say they jack the rates up when you need help the most, they have no morals, why should you? besides, im quite sure you have repaid this debt over and over if you consider the interest added to the debt, so please save your morality for someone who matters

              Blimey.... that's rich of them!! It seems like they're playing a very silly game here as £100 a month is a massive repayment by anyone's standards..... so reading between the lines, I would say that they're playing with you.

              Do Triton actually own any debts? I've never known them to.... and as such, any court threats are bluff. Personally, I would be paying zilch but it's up to you....

                Thanks for the replies.

                One thing in the case of the OHs CCA request, why send a photocopy of the application form, but a recon agreement? Surely if they kept one the other one would be next to it on a file?

                Or are they more stupid than I thought

                  Probably because the application form is all they've got...seems to me like they haven't got the agreement...

                    Also, there may not have been any actual Agreement in the first place. Some creditors have issued cards on the back of application forms but never sent an Agreement out afterwards.

                          It's for them to prove..... and they haven't; probably because they can't. Of course, they don't want you to know that, especially when you're already willingly paying them so much each month.

                          The advice on here is to reconsider your payments.... please don't be afraid to take that advice on board.

                            Triton pass accounts on eaiser than any of them, but sadly, whilst your paying they wont.

                            I wouldnt be paying £100 per month thats for sure.

                              I had an account opened with an application for a "balance transfer", I was actually sent a copy of this, as my "Agreement"!

                              Stop paying them. They can send as many reconstituted agreements as they like. Most Banks tell porkies, don't believe a word.

                              Wait for them to make the next move.

                                Not really posted for a while but wow yes i would stop paying, even if I had the money i would stop paying.
                                The other thing to remember is that the more you respond to them the more letters you may get.

                                Even if court action is a real possibility, that would be the time to think about an arrangement.
