Just a thought. Would it be worth trying the statute barred route as I am not sure when the last time a payment was made? Should I write to them and ask for a statement showing the last credit to the account? Any ideas? Thanks
I would do nothing at all on it, wait and see what they send and then be guided by Niddy or In to deep, if you send a letter asking when you last paid you will alert them to the possibility of SB and if its not yet got there but is close it could prompt them to take legal action. If you leave it and blag it you could keep things dragging on for another year or more by which time it is more likely to be SB and they will hopefully be out of time to take action.

Thank you Susie. Very much appreciated advice. How can I find out when I last made a payment as I binned a lot of old paperwork when I moved house in 2010?

Certainly not, as that would be a written acknowledgement of the debt and would therefore restart the limitation period.

As a Subject Access Request (SAR) made under section 7 of the Data Protection Act 1998 is specific only to the data subject and not to any accounts they may have operated, that may provide the information you seek.

Who do I send the SAR to as this applies to RBS debt not the MBNA debt as they are now in dispute? Where do I get the address for RBS to seend it to?
              Thank you
