      From personal experience this will fail - CCJ (or court papers) can be served to the last known address, and be deemed as served. I just lost a set-aside/adjournment and had the £500 bill (plus their costs) to go with it....

      Best to leave it alone until at least the 6yr period for reporting purposes.

      I have also replied to the other thread regards this matetr and the likely chances of a judge taking action

        Would that still hold if the claimant had sent the papers to an address the claimant believed was the defendant's last known address but at which the defendant had never actually resided or given as his/her "address for service"?

          Nooo only the last confirmed known address so in essence the address you last told them about however due diligence needs to kick in by way of cra traces etc to show due diligence.

          Similarly, if you move and tell them that address then move again and move a third time but the dca never knew of the middle address , if they served them there that's also acceptable.

          I won't pay it. I already decided I'll waste £50k equity in the house and sell at a loss to stop the c*nts getting my hard earned cash. Sorry it's a very sore point with us right now.
