    I agree with what you said Ken, yes too right to keep on at them DTME.

    I would be asking the FOS what evidence exactly did the bank provide them in order for the FOS to agree with them and not whoever was there at time of the sale!

      The only document NatWest provided to the FOS was a copy of the PPI terms, the rest is just the usual 'we would have done this' bollox.

      Here is part of my most recent letter to the FOS:

      In summary, on one hand we have Miss Xxxx's recollection of what happened and on the other hand NatWest are depending purely upon what their sales process should have been. As they have no records relating directly to the sale whatsoever, Miss Xxxx considers the above and any other assertions they make to be purely speculative and to carry no weight whatsoever. They were not there, she was. They cannot know what was said or done, she does.

      She also feels that is the view that the Financial Ombudsman Service should also take. The alternative is to say that Miss Xxxx is being untruthful and there certainly is not a shred of evidence to even suggest this.

      Don't know if it will do much good though as common sense obviously plays no part in the decision making process.

        Makes you wonder dont it.

        I did use this line when Hellifax were trying it on with us. But they gave in when we pointed out the branch that sold the PPI didnt exist anymore and unless the member of staffs notes were still available for the meeting then how could they say what happened that day. By not admitting our version of events they were calling us liars. A bank who is having to pay millions out for misselling the very product we were complaining about.

        Furthermore the fact we were in the branch to obtain advice about a mortgage and were told having another Hellifax product would enhance our prospects would indicate selling was going on.

        We admitted signing up for a card but said the application was pushed across the desk and told to sign next to the x. We understood it to be part of a pre mortgage application not the agreement to buy insurance of any kind.

        Hellifax dropped it like a hot potato then and paid up.

          any further in fo on this as im in limbo land with the same only the fos have upheld my complaint nut nat west have disagreed with the fos desision
          at the start of this journey i owed
          £52000.00 UNSECURED £5000.00 SECURED
          £0000.00 secured debt as of 17/12/2010 fingers crossed
          on 14/07/2012 i now have £32.000 unsecured and £15.000 unenforceable [thanks to niddy and aad ]
          as of 17/03/13 its now £26K AND £15K UE
          ITS COMING DOWN SLOWLY WHILE STILL ENJOYING MY LIFE

            Hi there

            thanks for posting.

            Right with it being upheld by the adjudicator and not accepted by the bank/business, the case will be moved on to the ombudsman to review, where they usually agree 99/100 with the adjudicators decision. Now in this case they "must oblige" to the ombudsman decision.

            How long ago did you get the response on this from your Adjudicator?

              Nothing yet - still in the FOS void. I think your own is more promising than mine though, FOS have already refused me once. Good luck.

                hi sorry not been online for a while its been about six months if not more will check my paper work tomoz nat west didnt agree and have done the same as with the op sent leaflet and said there system wouldnt have failed etc

                    At last I can update this thread.

                    As you all advised, I took this to appeal.

                    In December I received a call from a very helpful lady adjudicator at the FOS. She explained NatWest's 'normal approach' to me and then asked a few questions. I really must say that her 'explanation' about how the FOS views things did help me in how I worded my replies to her.

                    The outcome was another call from her three weeks ago saying she was "minded to uphold with my appeal" and would write to NatWest with her decision. She said she would "carefully word her letter" but she still felt they may appeal her decision to the Ombudsman and that they had three weeks to do so. She subsequently sent me a copy of her letter to NatWest.

                    Yesterday's post brought a FOS letter. It began with the paragraph we all hope to read:
                    "I am pleased to tell you that following our involvement NatWest will now be making an offer of compensation on this payment protection insurance (PPI) complaint".

                    Of course, NatWest now have eight weeks to contact me with their offer, so I will wait and see if they are, at last, going to play the game properly.

                    I must say, this success is in no small part to the advice and support I have received here. Heartfelt thank to you all for that.

                          This just goes from silly to stupid.

                          Text received from RBS today quoting the PPI claim number and saying. "We confirm payment has been made to your current account".

                          That's it. Nothing in writing, no figures, just the above.
                          I have no idea which account it has gone to as the two NatWest current accounts were both terminated seven years ago. I don't think they know the details about my (elsewhere) current account and has not been credited with anything anyway.

                          Maybe they have credited them to the Credit Card account (also terminated seven years ago).

                          TBH, I have no idea where the money may have gone.

                          Do you think it is just a standard text message generated by some computer at NatWest? It didn't show a phone number, just the PPI reference number where the phone number would normally be. shown.

                          Any thoughts or ideas, anyone?

                            I would contact them to ask which account because 2 of those are no longer open to you, so want clarification of what account they mean and the amounts etc, also contact the FOS.

                              It would seem that NatWest have calculated they should repay me just over £4,600 and they have credited it to my (defaulted and terminated) credit card account. It has almost cleared the o/s balance leaving only £300 or so outstanding.

                              I only know this because today's begging letter from Moorcroft shows a balance of £300 odd.

                              I intend to write to NatWest asking how they arrived at the final figure and asking for a breakdown of their calculations. By my calculations, this is about £3,000 short.

                              I also seem to think that they are not allowed to apply the statutory interest element of a payout to the account, or am I just dreaming this?
