Ref post 20, a tribunal judge regarding a variation on assets has recently overruled the 8% figure in a csa case. He set the rate at 5%.

Reclaiming charges is broadly similar to PPI, Di - in that the maths side is much the same. I think the main difference is the legal reasoning behind it. With PPI, we have the FCA & FOS rules to rely on - but with bank charges, it is mostly legal argument. I tell you this good lady - I reckon your experience with getting lenders to supply data older than 6 years will be very, very useful because a helluva lot of charges reclaims had to be shelved since the Judicial Review.

I am not used to the reclaiming of the bank charges like ppi but will be following this and learn the same time lol, will be good to see more success in this field x

There are actually only 4 categories the charges fall into..

O/D interest
O/D excess
Failed S/O
Failed D/D

but there are slight variations on the O/D excess names as the years go by... but all one and the same.

Only O/D interest was not calculated on my original sums - everything else was

Yup - those were all accounted for in my original calculations im fact, they make up the biggest sums - so no complaints there :P kinda shafted themselves on that one really if I am successful!

In that case, I guess you'll be reclaiming those fees, as well as the other charges.

They just all show up as a combined, single "Overdraft excess fee" of varying amounts.. from £20 to over £200 each applicable month...

I guess the charges for those letters will be shown in your statements, Shad - so worth checking.

Reminds me of something I'd forgotten - they used to write to me to tell me I'm overdrawn - and to advise that for writing to me they were going to charge me £20-£30!!

No such letters have been included in my SAR data - and I had totally forogtten about that until just now!

...............Sorry i forgot to add, despite the critical hardship we were in, the bank bombarded us with crazy letters, added more charges and interest and with that there was never money left for the mortgage repayments, as they were adding more and more all the time, and we were sorting it our in writing, also on the phone to them almost everyday with plans, but they didnt want to know, so I do really hope you succeed in this.

Am going to follow this with great interest.
Because of lloyds, i almost lost my home and still have a few accounts with them through their collections, cabot etc, my mortgage had to be split to 2 parts for interest and repayment on the other, as they messed up on our income a few years ago.
Then this led to my hubby's depression as where he did work back then (steelworks) went into administration just a few days before xmas, and years on due to my blood pressure rise over the years its led to a critical illness of CKD, I will be a renal patient for the rest of my life, my specialist told me stress had a big contribution to my illness.

We were fit as fiddles before all the crap we taken off them. Sorry lol but i hope you dont mind me posting here and hope you do get success!
