thinking of my own thread on the subject. having read that sometimes correspondence could be regarded as without prejudice even if it was not formally marked so depending on its content. but then the case of bradford and bingley v rashid where it was said that sometimes even if correspondence is stated as without prejudice, it could still be regarded as admissible as an acknowledgment regarding statute bar depending on its context!
