So, does not being able to provide a default notice mean they dont have one? I dont recall receiving one, but I know thats not the same thing!

I'm quoting your post #13 in which you say Lloyds admit (in their SAR response to you) that they told PRA there's no record of any Default Notice being issued/served.

Take your time before you respond to this claim.

That would not be the appropriate CPR 31.14 letter to send to the Claimant's solicitors since the OP has already sent a s77 CCA Request in August (see post #6) and Niddy has deemed the credit agreement sent in response as unenforceable (see post #10).

A subsequent CCA Request runs the risk of the Claimant making the effort to remedy a potential legal flaw.

I have just been reading up about this claim

You need to tread very carefully now with this because if you make a small mistake now it could make a massive difference down the line - And we certainly don't want that do we

          Before you do anything

I would strongly recommend that you contact Diana Mayhew ( Her post is above this one). She is fantastic and extremely knowledgeable about these situations and works with our preferred solicitor company. They are really approachable and will offer free initial legal advice to forum members such as yourself. You have absolutely nothing to lose. Her email address is:
          di@joannaconnollysolicitors.co.uk

Just drop her a quick email explaining that someone from the forum ( mention me if you wish) said it would be a good idea to contact her

Hi. Long time no post, but things here have progressed well. PRA did indeed put a claim in for this, and I worked with JCS. I have to say that they, Colin, Di and the team were great. Essentially, PRA were in no position to produce all they needed to make a claim, and this was clearly visible on the SAR I made to Lloyds. Eventually
PRA has consented to it being dismissed, a process I believe where an order is produced by the court, which they need to pay for, and no further action. A great result.
Learnings from this are clear, take advice from this great forum, be patient and do not let the buggers get you down.

Many thanks to Colin and Joanna and Di for the help with beating Lowell .
This is the second Discontinuance they have helped me with , one with PRA .In my view money well spent.
If you get a claim , message or talk to Di or Colin their expertise will put your mind at ease , once appointed they will lead the way leaving you to carry on with life. The great value cost far out ways the cost if you get a CCJ.

There’s no better advert for something that works then the voice of those that have experienced it.

well done to all at JCS and thanks for being here for us.

It's always a pleasure beating the opposition, but it's also nice to know that the client feels they have beaten a business which has tormented them for some considerable time.

I'm glad you were able to turn the tables on them in the end
