I’m sure Di will post something to help you, but do not worry about bailiffs, the worst that can happen is that you will lose and be told to pay; you will then let the court know that you can’t pay and ask for a repayment plan based on your income. This is a very simplified version of events to put your mind at rest, more details will follow later.

Thank you for this, my worry is based on reports of Rottweiler like activity by the Council. Bad luck on Saturday against the AB's!

Cymru, in your opinion should I attend the county court? Jo said I don't have to. If I do not and they obtain judgement at what stage do I inform them of my circumstances? Do I do this via a court form or letter? My major concern is their debt collectors swinging into action! Thank you for your help....despite the fact that most of my injuries were inflicted by the Welsh!

I would always be guided by Jo, she is the specialist with knowledge and experience. If judgement is entered against you there is a form to be completed; you are always given 30 days to pay. Debt collectors will not be swinging in to actin!

Does anyone have any experience of how the clearing banks view CCJ's? I'm referring specifically to my own bank, are they likely to close the a/c? The a/c is always in credit...just! so no overdraft, loans or credit cards.

I doubt they would close the account, as long as you are in credit they should not have anything to worry about. If they closed accounts for anyone with a ccj there would be chaos

I have been thinking about this! As far as I am aware the bank will not be notified of any judgement and would only find out about it if they did a credit check on you. There is some peculiarity, (I’m not sure of the exact details) where a CCJ sometimes doesn’t show on your records. I would not let this worry you as there are many members who have had CCJs and continued with their same bank.

Am I correct in thinking that once judgement is granted to the claimant and I am unable to pay I complete form N245 and return to the court? I'm sure the claimant will not accept a token payment on a debt of 5,500 but this is all I can offer. If I can prove to the court I live on a state pension, have no assets except an old car and partly support a child still at college is the judge likely to confirm the arrangement?

Blind panic is setting in over this!

Don’t panic! The courts are quite reasonable and if you haven’t got the money you can’t pay. If you complete the I and E for the court and return it to the court they will make a judgement on what you can pay. If this occurs just make sure that you allow for all outgoings and only include your income it is not based on the household income, but also include all your expenditure. Courts have been known to make orders for a very small monthly sum......

judgement entered against me 1st week December. I received a letter from the other side's solicitors 19th Dec requesting payment / I&E form completed by 25th Dec.
No communication from the court either to me or Joanna Connolly Solicitors! Court admin must be in a complete mess. Can anyone advise if the 30 days to pay commences from judgement or formal notification by the court? I assume the former?

Form N245 just completed and lodged with the County Court....is there a time limit / end date for lodging this? obviously I assume this must be done before any further action / warrants etc applied for by the other side. I had a particularly surly and unhelpful person in the court office to deal with so our conversation was brief!

                            Happy new year!

I have been called for questioning at the local county court in a few day. I wondered if anyone here knows the procedure, what sort of questions they'll ask etc.
I have some paperwork ready including bank statements, evidence of other outstanding debts along with anything else that's relevant.

The plaintiff did not accept the offer I made...they seem to think I have more funds/assets than I declared! Well - tough luck on them...I don't! One thing bothering me is my wife owns our house and it's solely in her name, always has been the case. Can they do anything about this? I'm guessing not. No joint a/c's or other financial relationship. My sole income is below the basic state pension which just about covers some basics.
Any advice would be very welcome.

Can't offer any advice (other than to answer truthfully) as I haven't been in that position, but I can say that they absolutely cannot touch what is solely your wife's property if the debt is in your name alone.
