My fingers are crossed that all goes well for you at the hearing tomorrow in your absence.

Call the court after 4 pm to see if they can tell you what order was made. They may say it'll take a day or two to update on the system. A copy of the order should be sent to you in 5 - 7 working days. When you get it email me a copy.

Thank you for your wishes. I'll pass on the news when I have it. Worst case scenario is understood, anything else will be a gift .

Re: Charging order for £3k, is this good or bad news?

Thanks all. I didn't get to call the Ct today and I'll probably wait for the order to arrive in the mail so it'll be a few days before I report back I'll be very pleased if the Judge grants my request but won't be downbeat if the basic CO is granted just so long as that's an end to the matter .

                  That's a healthy attitude Mike'y.

The good thing about (civil) law is that it does seem there is almost no such thing as "an end to the matter" apart from the Supreme Court. And even then you can always try to argue your Human Rights (until Cameron removes that option as he has pledged).

If circumstances change there are usually ways to go back to court and argue again. Although bear in mind that in some cases either party can do that.

At the moment you still have a CCJ ordering £50 per month payment instalments. You are currently in breach of that order and have been for the last three years. You may need to get that fixed in preference to relying on Restons' goodwill.

I'm only just learning the meaning of the magic word *vary*.

Let's see what the DJ decided before we speculate on what may/may not happen next. But as you say you're aware of the worst case scenario which would be an application for an Order for Sale since the property is in your sole name. As I understand it you would have the option to defend that application. Let's hope you never need it though.

Take care and keep us posted.

A valid point Plan B. I shall see what happens in the next few days

You are so chilled not ringing the court Mike'y. If it was me I wouldn't be able to bear the suspense!

Hi Elsa, I'd just end up speaking to an unsympathetic person who would say the 'Order' had been sent to be typed up. Then I'd have to wait while a person went off to find the information etc. It's a done deal and will arrive in a few days. All I can do is wait. Whatever I get it won't be a box of chocolates he he. So, no exciting surprise today.

                          Hi all

Got the CO through today. DJ continued the order but there's no 'no sale' clause which is what I half expected so I'm not dissapointed. I'll just see what happens next, if anything. What is good, that I didn't mention before is that this order is only for the original judgement debt. It makes no mention of the fees I was ordered to pay to Bryan Carter when they obtained the CCJ. I will have to pay the costs for the CO hearing though as they were added to the CO. That's only to be expected. Thus far, it's not been a bad day
