        I think that is right Miss Molly.

        I beleive that you may have to provide a letter of appropriation, listing priority debts.

        I got that information from another place

              Usually this is done if you say get HB paid into your bank and need that for rent but for normal benefits then you can simply say "it is my normal living expenses"..... you don't need to list what you'll spend your JSA on, more the fact you're spending it to live.

                Wonder if its worthwhile trying to resurrect my Barclays complaint with this. Didnt occur to me at the time (and was before the forum anyway).

                Think my stumbling block will be they were mostly the "reserve fees" (£22 for five days) BUT it was the application of the FIRST set of fees that caused the issue - i.e. the charges got applied at end month, sent me over - bang another set of fees.

                  I've sent off a complaint to the FOS...
                  They have got back to me and are dealing with itso it's a case of justsit back and wait now.....
                  I used to be afraid of the post... Now I look forward to it - so I can stick it to the DCA's

                    Halifax refunded fees after a Letter of Appropriation was sent years ago when i was on Benefits. They didn't reply to my letter though..... they just did it.
                    Remember the mantra:
                    NEVER communicate by 'phone.

                    Send EVERYTHING by Recorded/Special Delivery
                    Keep a copy of EVERYTHING sent
                    Keep hold of EVERYTHING received

                        I would complain to their Chief Exec.... and ask for the precise point of law they're relying on with that kind of response. IMO, the FOS are a waste of space...

                          They can be good and bad, I've had a good experience with them (TxtLoans thread) and a bad one. I made a complaint on their website and was told they would contact both me and the bank for more information and our sides of the arguement (only basic info was supplied). They never spoke to me, but spoke to the bank and surprise surprise, they ruled in the banks favour.

                            I already did... Ages ago and they passed it onto a Mr Webb, who I have been having email ping-pong with and he said he'd pass on my letter to the legal dept and they came back with what I put further back in the thread.

                            So, that's why I have taken it to the FOS
                            I used to be afraid of the post... Now I look forward to it - so I can stick it to the DCA's

                              That's why, if I don't get the desired answer, I'm taking the bank to court.

                                Hence why I advised you go to the Chief Exec..... and bypass the "legal dept'.

                                Santander need to be challenged on their interpretation of the law as their "legal dept" seem to have adapted its content to suit their own ends (your other thread).



                                I doubt they would stick to their stance if pushed for a breakdown of where it comes from though....
