      I am disputing a few details within X bank as they have placed me in an unmanageable situation, which I am disputing, as is my right within certain sections of the CCA1974 and associated legislation.

        Thanks Niddy... Can I still apply the above reasoning bearing in mind they didn't actually hike the APR of an existing loan but Sold a new loan to us when I approached them in a position of financial difficulty?

        Also, it's just dawned on me.. when we were sold the second loan Mrs Oik was 7 months pregnant.... part of me recalls them chosing to over look that.... Is that legal?

            Ok then change it - I have changed the above quote to incorporate this fact however they would never be able to find this info out as the bank are not allowed to discuss it with them.....

            Nope, no legal ground for dispute on this really..... if she applied, then how was it an unlawful mis-sale based on being pregnant?

                  Do you already know what information about this debt is actually showing on Equifax, Experian etc? There are mixed views on getting hold of credit files so I'm not going to stick my neck out and suggest you do this unless you already have done.

                    Definately, Thank you!

                    @PlanB... I have already Done a Registry check on the Property I resided at when the Loan was active.... I have also got the Experian/ Credit Expert report... I can see no evidence of a default or outstanding loan on either of the reports.

                    I will get the experian and call credit reports this evening.

                    I know some folks say they sell your info on to your debtors, but I fear thats a risk I need to run!

                      Are you able to name the High Street bank which provided the loan? Some of the guys on here have reliable insider knowledge of which banks report what to different credit reference agencies and other knowledge databases such as Hunter. Once you know precisely what has been put on record it'll be easier to pick the exact right words to match for your answers to any HO questions.

                      When did you last pay anything to this debt, was it 2008? The worst case scenario if you have been given a default would be to apply to the police force once that has dropped off your file in 2014 Someone else will comment on whether a statute barred debt would be an issue with those Home Office questions

                        It was Natworst bank.

                        I think the last payment was in 08. There was a 28 day notice of default action in Feb 09 but they sent a lot of threats over a period, so until I am with all the papers this evening I can't be precise, sorry.

                          No rush Better to have all the facts in front of you before making a decision on what to do next. From what you've said I should ask whether the loan was in joint names with your partner and has anything been registered against her name and not yours

                            Do you know what, just answer as honestly as you can and don't worry about this - really, it's not that bad and I know 100's of people in central government with bad credit.....

                            Point is, are you dishonest and/or liable to take bribes? That is what they're looking for, they don't care that you missed last months Visa bill

                              Hey Folks. So I've come home and tried to aquire my Equfax and Call Credit statuatory checks and both are saying there is a problem with my payment method... I can't see it written anywhere, but might it be neither site will accept my Visa Debit card?

                                Can anyone shed any light on my above predicament at all? Is it just that they wont accept the card type or might it be something more problematic?

                                I think CallCredit has a pay by postal order option, but for some reason these shenanigans make me feel a little uneasy.... :/
