    Re: help needed

    Hi LooLoo,

Glad you dropped the 'p' by the way. I have no experience with DMPs but when we tried to talk to our creditor about the cards and my health problems, they just turned the dogs loose on us and we were all up to date at the time. After a two year battle to stale mate, they get nothing at all and according to our sols they ain't gonna get nothing either.

    regards
    Garlok

i know these companies can be very fickle, but surely you'd think if i explained to them that they either agree to stop interest so that i can pay them off, will happily accept a default! Or it goes to a dmp and they get next to nothing through that.

        Hehe you noticed!!

Yes same as with me when i rang pleeding for some time to breathe no one wanted to listen - I can remember a very tearful convasation with the National Debtline. My only regret is that I spent a year on the DMP when i really could've started my UE journey (sorry GC for using your thread for this as I know UE isn't an option)

            You would think that eh..............

It really depends if you get a robot or a real person on the phone and I have learnt to put everything in the first instance in writing.......

They may agree in the short term to do this but each case is different.

thanks loulou, i have realised i have time on my side as i dont need to make any payments for another couple of weeks. I really am starting to think if i can do something about these CCards the rest of my debt is sort of manageable, maybe i should go down the UE route on two of them and try and get the other to ease the pain a bit, gotta be worth a shot hasnt it?

                  UE you mean?

Well for 2 of them, yes. Possible.

Yes, i must go and read up on this route. basically the way i see it whatever i do my credit file is going to be shot, but if i did a dmp for all my debt it will take ages 10-15yrs to pay off with a lot of hassle, if i can just deal with the CC's my life would be much better. Would anyone think this was a good way forward or should i just stick with the dmp?

                      Thanks Riz,

Didn't pursue this angle because Niddy earlier thought that it might not be worthwhile for the £11K. It might be worth a try on the pre 2007 ones.

I figure if you're going to default those accounts anyway, then you may as well see whether there is an enforceable agreement.

                          Just my opinion though.

I wonder if anyone could advise as to why it may not be worthwhile? sorry with all the questions guys.

You seem to me to want to go the UE route with 2 of them, so why not just do it and sort out a DMP with the rest. If it turns out that the two you've gone down the UE route with are enforceable, then you add them to the DMP.

I suggested not to bother as you have property, too much risk of the lender looking at a quick CCJ/CO what with you having 2 properties however no harm in sending off for the CCA's - none whatsoever.

The normal process would be to send a CCA Request to all creditors, include them all just to see - that way it also buys you some time while they dither.....

So you'd stop all non essential payments to unsecured creditors (loans and cards) and send a CCA Request and then update us with what they sent you, we'll then clarify if enforceable or not and then at the end of it, when we know the results, you then sort a DMP - in the meantime, yea your credit file goes to pot (so what) and you save a couple of months payments, at least it gives you some breathing space!
