Re: Please help
UE probably isn't an option here - let me have a proper read and i'll come back to you.
Too many people try and hide behind UE and unfortunately it is not always the way to go - NOT when you also have so many debts that are CCA1974 exempt (overdrafts etc) plus your house situ means if I was you, walking away and making a new start with £0 owing is the best option.
That was my original opinion and that opinion still stands. Let me have a proper read...
CAB Insolvency help is here: ---> http://www.citizensadvice.org.uk/ind...s_20060804.htm
National Debtline help here: ---> http://www.nationaldebtline.co.uk/en...=01_bankruptcy
ps BOTH the above services are free, confidential and independent.

Re: Please help
Thanks Elsie, the unenforcibility thing is interesting as my biggest debt, egg credit card was applied for online a very long time ago. They have already defaulted me & said my account remains open only for repayment purposes, how do I find a letter to send to them to request CCA? Thanks x

Re: Please help
Thanks Niddy, All I have felt strong enough to do so far is look on the CCCS websote & fill in their debt remedy tool, I was so scared of posting on a forum too.
Could u point me in the direction of insolvency info on here by any chance? Also if im bankrupt does my house get taken away & does it mean I cant keep my bank account?
Thanks x

Re: Please help
Hiya
Have you read this section on Uneforceability.
http://forums.all-about-debt.co.uk/showthread.php?t=4
If you have credit cards pre 2007 and you have already been defaulted on them it may be worth having a read of this.

Re: Please help
Have you actually spoken to a professional body about your problems, all in all it may be that a formal approach could be best here, ie insolvency.
I would be looking to speak to a proper debt advisory service such as CAB or National Debtline even, just for some neutral advice regards formally closing your debts - horrible word called bankruptcy.
As most the debts are relatively new, there isn't much we can expect from haggling repayments, it'd take forever and a day to clear so maybe just maybe you should consider the more formal approach and wipe the slate clean - it'll also benefit your health dramatically.
Best of Luck
Niddy

Re: Please help
I've just sent a message to the moderators who might not have seen this thread to see if they could come up with any more advice. I'm not feeling too well today myself.

Re: Please help
If the house sold tomorrow at the price its on for now I would get about 18k back (I put 60k in 9 years ago)but my debts are around 35k so I wouldnt be able to pay anything off, the house is now valued at 30k less than I paid for it 9 years ago its all just such a mess x

Also I have another 9 months on the lease in my current property & the penalty to leave it early is almost 6k, the mgt payments & rent payments are about the same so I wouldnt gain anything by leaving here & going there sadly. x
What a bummer of a situation for you. Are you going to come out with anything even if the house sells tomorrow? Is it enough to be worth all the worry?

Re: Please help
Just wrote a long reply then lost it because I timed out
Sorry to hear that you've been in hospital - hope things are better now.
I can understand (from personal experience) your reasons for not wanting to live in the house but would it not be worth it (financially and health-wise) for a short while until it's sold?
If it's been on the market for almost a year it would seem that it is priced too high to sell in the current climate. Again, financially and health-wise, would it not be worth it to reduce the price? Is your ex-husband doing something to discourage viewings? After all, it would seem that he has the most to gain if it doesn't sell.
How much does the ex pay towards the mortgage? It should be the same as it would cost him to rent a similar home.
Would the equity you have in the house cover your debts? You could consider unenforceability on your pre-2007 credit cards (overdrafts aren't covered by it) and then perhaps make full and final settlement offers once the house is sold.
You can find out when cards/loans were taken out and if they have been defaulted by getting a copy of your credit report.
Sorry if it seems like we're asking lots of questions. It's just that we're looking at all possibilities for you.
