    I'll pop back tonight, bit busy today but will be around later. I'll then check all your uploads etc as on phone at moment.

      I couldnt say exactly when the last payment was made. It could of been after. honest answer is I dont know at the very latest it could of been dec 2006.

        Ok thanks. On your credit report, what dates are showing?

        Also, I'm thinking it may be best to blag this until SB so I really hope you've not admitted liability anywhere. Can you clarify a rough chain of events in that;

        A) have you spoke to them and admitted the debt or;
        B) have you admitted the debt in any letters; what letters have you sent the bank?

          ps we'll come back to the credit report. Do you have a copy of your report or even better in the last 6 years have you EVER obtained a copy via paying the £2 statutory fee to either experian or equifax?

          If so we can sort the default - piece of piss. However right now that's nothing, we have to ensure accuracy on dates so if you've ever obtained a copy of your credit report within the last 6yrs great - simply SAR the cra and they'll attach a copy which will show the original default. Then we'll also find the date last paid and be able to work out the SB date before demanding default duplication removal via the cra's.

            This is what it says on my CRA file for experian



            No I haven't admitted the debt by phone or writing. I sent them the usual CCA request and then the that's not good enough as cant read, account in dispute and unenforceable letters.

            Yes without a shadow of a doubt I have had my credit report within the last 6 years from Experian and currently for the last 3 months I have been paying the £14.99 per month fee to sort this out.

            Makes total sense, logging into Experian now to see how far back I can see on prev credit reports and I will even ring them if I need to

              Just rang Experian and glad I did.

              No need to SAR them. They are sending the previous reports out to me in the post due to DPA.

              The dates I checked my file in the last 6 years are
              • 12th Nov 2008.
              • 18th Nov 2008.
              • 21st Nov 2008.
              • 25th Nov 2008.
              • 4th Dec 2008.
              • 6th Dec 2008.
              • 9th Dec 2008.


              Must have been a free period of getting the file. Apart from those dates I haven't viewed until 3/11/2011. So I'm hoping that a default if any will show up on one of those reports.

                Thanks for the reply. Should have the reports within 7 days so will soon find out what is on there.

                  Rizzle's site team and can hard delete messages. Maybe he changed his mind over post? Even we can't see it

                      Been a long time since I updated this but there has been some development on this account in the last few days.

                      Firstly late last week I got a letter from NRAM saying that due to errors in the CCA and to redress the consequencies of charging interest during the period they sent non-compliant docs they would repay the interest. So nearly £3,000 in total to be repaid.

                      However the refund would be applied to the balance of the account and reducing it to just over £15,000 now.

                      They defaulted the account at £18k but surely that default was wrong?

                      Logged into noodle and the loan from the together mortgage isn't showing at all on my credit file.

                      It has to be SB now anyway but just wondering what I should do? Do I make a cheeky complaint and ask for the £3,000 back or will that be admitting the debt and then reset the clock for SB? Although £3,000 would be very nice I'd rather have nothing than have to repay £15,000

                      Is it just best to leave this account alone and leave at that or just fire off a SB letter to them?

                        I'd leave it alone myself. They won't pay you the funds, sadly.

                          Once there is a period of six years with no payment or written acknowledgement of the alleged debt, it is permanently statute barred. Absolutely nothing you do can change that, even if you dance down Piccadilly in the nude with "I owe the money" tattooed on your 'arris, and auto programme your online banking to make a million £1 token payments a day.

                              Bit of an update on this as going through some old papers today and found a letter from McKenzie Hall from 2011 saying that the account was not statue barred because the last payment was paid into the account on 3/12/2007 so 6 years is up this December.

                                Assuming Muck Hall are telling the truth, which is not exactly the safest of assumptions. You can be sure, though, that the real last payment won't be after this date.
