    Hi all,

    Sorry for the delay but I've been stuck on the A14 once again.

    I didn't want to start an argument that's for sure but I really do appreciate all your views.

    In answer to the postie question, yes I do have a chat with him most days as he's been my postie for 10 years. As to where he lives, I have no idea.

    I actually got him to write a statement the same day as without even opening the envelope you could see what it was straight away. Default Notice was in plain sight through the window envelope.

    It was posted TNT with a big "S" on the top left hand corner just like UK Mail.

    I have attached the said DN for you all to take a look at.

    One other point I have noticed on the DN is as follows:

    "IF THE ACTION REQUIRED BY THIS NOTICE IS TAKEN BEFORE THE DATE SHOWN NO FURTHER ENFORCEMENT WILL BE TAKEN IN RESPECT OF THE BREACH"

    As I've already pointed out , there's not date provided.

      In answer to your UE question I haven't really thought much about it to tell you the truth.

      This is what I have in regard to an agreement but wouldn't have a clue if it was UE or not.

                Cheers FP, kilasuit advised me on how to upload in the future.

                I emailed Niddy and unfortunately its not UE but I didn't think it would be so nothing lost and nothing gained. Hadn't thought about UE anyway.

                Would you know if anyone has looked at the DN they issued yet?

                  Hi all,

                  Is there anyway of telling when this letter was processed through the Post Office via TNT

                  There's no postage stamp as such but 2 orange barcode sort of things on the envelope

                    Found this information

                    Orange Barcodes. Upper one does contain a date. Royal Mail knows when that Barcode was printed, by which machine, down to within a 30 minute timescale.

                    If you ask Royal Mail they will de-code it for you. Or you can ask a Judge to demand that Royal Mail de-codes it for you!

                    So me thinks when I'm finished my last round today I will pop to the sorting office and get them to look into this for me.

                    The more evidence I can obtain the better chance I have of telling Santander to stick it where the sun don't shine.

                      They have already refunded all of the PPI to the loan account. That's why I went to FOS about mis-selling and they ruled in my favor.

                      So, they have paid the loan for a year and refunded all the premiums.

                      Would be nice to reclaim it twice but I don't think they would fall for that one

                      It's more about the DN and if it's invalid. I think it is personally but would like an expert opinion on it.

                      If it is I will continue to pay them a reduced amount as agreed and when they finally pass or completely assigned it to one of their DCA monkeys I will pounce on them.

                        Afternoon,

                        Anyone had a chance to look at the DN I posted?

                        Just need clarification as to whether its legit or invalid

                        Post office will be advising me when the letter from Santander entered their system within the next few days.

                        They can tell when, where & what time by the first orange bar code.

                        So fingers crossed they come back with or around the 16th - 17th and it's tough sh*t Santander

                            Hi,
                            I've just had a look at the DN, and unfortunately it states 14 days from the date of service (receipt)
                            not the date of the notice, which clouds the issue. They still should have given a specified date though.
                            Have they terminated yet Scrappy?

                              So when is the date of service? If SC does not acknowledge that he received the DN, he can never be in default of repairing the breach, because the creditor cannot put a date to it.

                                I was under impression and have been told that they had to specify a date.

                                c) if the breach is capable of remedy, what action is required to remedy it and
                                the date, being a date [not less than fourteen days] after the date of service of
                                the notice, before which that action is to be taken.
