    Remember they defaulted me the same month they shut my account - on my Niddy v HSBC thread!

    Oh, I have done a stonking ICO/FOS complaint regards that alone - will upload it here by the weekend as I'll finish that tomorrow and that will show you how to demand a dodgy default is removed - not easy, let me put it that way - I bet even with the facts I provided to the ICO as part of my complaint, they side with the bank even though I have covered every angle, exemption class and default remedy - they are screwed (HSBC) but I need the ICO to agree with me to help my FOS complaint. If the ICO side with the bank my case is doomed.

    Shadow - hold fire on this, as I say I have done a huge complaint about this exact same thing only yesterday but its on my work PC and I'll upload it tomorrow night for you - that will show you the points I am fighting for, however in your case I really think you need to stop worrying and forget this and let it become SB.

      Yes, I did miss more than 6 payments

      So I guess I have to let it run it's course.

      Yes, you would think that a default of that age would have little impact, but originally, for some reason, I could not see this account on any of my credit reports, but lenders did see it, because every application I ever made got "Deferred" - and usually declined after manual review.

      When Lloyds removed the entire account for one month from all CRAs, I obviously could not see the difference, but a Barclaycard Platinum I had applied for several times over 2 years and always declined after review was instantly accepted, with a limit of £2.5k. I had the card about 2 weeks, and had not made a single transaction on it, when I received a letter stating it had been terminated as I no longer met their criteria, but they would not stipulate on this when I rang the provided number. They said it was confidential information.

      I checked all CRA's, and credit report had the account back on there, with the information it should have had all along, but a different address (the correct address that they hadn't updated in 2006 when I informed them of address change and they failed to update this account).

      Since then, any credit application is instantly declined - not even referred anymore like it was. The date of default is still the same as it would have been all along, and I am no longer at the address that the default is reg'd to, but still have access to that address for any letters they may send.

      I will take a snapshot of the credit file in just a sec and upload -Emailed!

        Have a mooch here. If you wanna argue the DN on your credit file, then the guidance notes used in my complaint are relevant to an extent.

          Thanks for that.. I do feel that I dont quite have the argument you have - I do feel the default is unjust for numerous reasons, but the basis that I actively did not pay into the account for all that time would still as you said make me eligable for a default, so even if I won my argument that it was served incorrectly, I dont think that would make it removable - or they could remove, and then reject any offers for reduced settlement, and default me again as I could not afford to pay the full balance in 14 days - even 50% would be a tremendous struggle, but possibly achievable by loaning from family!

          I think I will just have to ride out the default, which really sucks - and just keep this information in my hat if they do try as a last ditch attempt to take me to court for recovery before SB kicks in. I have checked my statements and I THINK that the last payment I ever made into the account was october 2007 - so they dont have long to go.

          I have never sent them anything in writing with a signature either - I did email the CEO (when I suspected the account was identity theft, so far from acknowledging the account), and then emailed the Customer Relations officer dealing with it requesting all interest and charges be refunded and reflected in the balance - but again, this surely does not count as acknowledgement as it was not signed by me - anybody could have written it?

          The request for payment they sent me seems like it is just a couple of copy and pastes - and that the top half doesnt even relate to the bottom half - so Im guessing they just sent it on a whim on the off chance it might get me to consider payment!
