Worth sending a CCA Request

It seems likely that Intrum could obtain a copy of the original agreement with Tesco. While there may be issues with the assignment chain, Intrum would work on the basis that the alleged debtor is unaware of that. (In any case that is an argument which would require legal representation.)

The OP may be happier to pay the £1 per week for the time being, for a quieter life. That in itself may not stop Intrum pressing for more, but stopping payments altogether is more likely to prompt a response.

The Loan was a Consolidation of existing Debts. This was known to Tesco meaning that they Dressed Old existing debts with a New complient CCA.

CCA covers variety of different TYPES of debt all of which are treated slightly differently.
Some may even have had PPI for instance.
Digging and research here might be to your advantage.
Was this Loan for instance suggested to you by the OC? Were they aware of the purpose of that Loan?

Its actually for the OP's peace of mind because whatever he pays wouldn't stop Intrum!

Its called dressing a turd. If the Old Debt(s) where UE then the Consolidated Loan will be fatally flawed irrespective of whether the CCA is EN!

Does it show this in the SAR?

As for Debt Managers and their group of Companies were they FCA Authorised? Is also an issue!

Stop paying the £1 per month because it keeps restarting the Statute Bar Clock! Its nolonger being reported with CRA's and wouldn't stop Intrum for issuing a claim anyway.

As for ResolveCall politely wish them a Happy Christmas as you show them the door. asking them to close the gate on the way out! SILENCE is GOLDEN

So some homework is required a Diary type format will help you and AAD here!

I appreciate your issues and problems but this is where a Diary format helps.

Perhaps the first question should have been was this Tesco Debt New Monies or to pay of various accumulated debts?
It was quite a large sum and it seems was unsecured?
Tesco must have been aware of the basis and background for your Debt!

Did Tesco send you a Default Notice and when because again this is never mentioned? Yet Default Notices are important documents.
Then comes the question of Debt Managers
With Assignment chains (because now Intrum were assigned the debt in 2022)
Exact names become important. Can you please advise who with Debt Managers was assigned the Debt from Tesco?
Next Intrum again Who in the Intrum Group was assigned this debt!

Hi Roger thanks for this.
The tesco loan was to pay off existing debt and when I applied I told tesco it was for debt consolidation and was an unsecured loan.

Once i started having payment details i told tesco and they allowed token payments and after six months they sent a default notice this was on my credit file and now my credit file does not show the default as that went last April 2022.

All I know it was debt managers I didn't have a particular person dealing with it it letters were always signed with the managing director (name escapes me but can check once home) I will also check of what branch of debt managers

intrum again the letters are always signed off with Gavin Flynn operations director. If an email was sent and any reply was just random call centre staff. Again after reading the helpful link above the bottom of the letter (which I can't upload for some reason) says

"intrum uk Ltd is registered in England and Wales with company number 03752940. Your account is administered by intrum uk limited ("intrum") for intrum uk finance Ltd. Intrum is part of the intrum group whose registered address is the omnibus building lesbourne Road reigate Surrey Rh2 7jp.

Intrum is authorised and regulated by the Financial Conduct Authority for certain credit activities and is registered on the financial services register under registration number 718918"

That's reassuring that no one seems to get numerous visits from resolvecall. I certainly wont be engaging with them.

I don't think so, they are just a middleman. I would keep paying Intrum the £1. I wouldn't volunteer to increase repayments at the moment (finances are getting tighter for everyone). Usually the people here send Resolvecall on their way without engaging with them, and they don't hear from them again.

Yes tesco provided a SAR to me in 2021 with paperwork when debt managers had the account. In 2022 intrum bought the debt from debt managers.
I have only been paying 1 pound a month and this was agreed by debt managers and intrum. It would make sense to think I have some money but obviously I don't. Intrum are saying to pay resolvecall as they are acting on behalf of intrum now. Is it worth writing to resolvecall to offer them the payment ?

Hi all

I thought I would update here as life got in the way as per normal. I am now fortunately in a better place with work and my health.

Tesco replied with around 100 documents in the SAR request. Statements, cca, terms etc so as niddy looked and believed it was enforceable. He hasn't seen all the documents though

So I have continued to pay my debt as listed which was with debt managers. Debt managers sold my debt to Intrum in 2022.

I have only been paying 1 pound as that's all I can afford. Intrum started sending me offers to clear the debt up to 50 percent off in August 2023. My brother offered me 3k to clear it which I put to intrum as full and final and they said no they would only accept the 50 percent.

I replied stating I shall continue paying 1 pound.
Then in November I had letters from resolvecall threatening home visits as I haven't been in contact with intrum.
This isn't true and i have replied to intrum to which they have ignored me.
I have sent resolvecall the "you have no permission to come to my address" letter and they are still threatening to come round.
I have written to resovlecall stating I have been in contact and continued paying the 1 pound and they have ignored me as well.

It's starting to affect my health again and fed up with these companies. Is it worth resending a CCA request as it's changed hands?
Does anyone have any recommendations where to go from here.
I can probably up my payment to 20 a month but that's it

I called tesco to see what they wanted and all they wanted was to confirm date of birth and the original address where I took the loan out.
They already have all these details as they sent the CCA to debt managers with all that information already. They are sending everything they hold on me within 30 days so will see what they actually send

Thanks everyone. I will try calling to see what information they actually want without telling them anything. If I'm not happy I will send another letter with an anti tamper signature strip. I have changed address which probably doesnt help.

With the Anti tamper signature strip. Make sure you signature spills outside and over the Strip. I used to do it diagonally. Then either photocopy , scan or use MOB to photograph your signature! Take every precaution to reduce the possibility of it being LIFTED!
