After reviewing the Account, it has become apparent that it is now subject to Section (5) of the Limitation Act 1980 and as such I have now closed the account.......This means you will hear no more regarding this matter and it will not be passed anywhere else for recovery...."

I proofread that letter three times before posting it. How the hell did THAT slip through???

I only hope you cleaned the letter up before sending it, to avoid looking as big an idiot as the goof who is making this post.

have Capital One Credit Card (less than £500) never had copy agreement - last payment Sept 2008 so in essence statute barred. Copy of agreement suddenly retrieved by Lowell

Have you sent Niddy a copy of that CCA from Lowell to assess whether it's unenforceable? If not email it to webmaster@all-about-debt.co.uk .

If it's UE it'll matter less whether it's SB or not. Always good to have two sticks to beat them with
