    Re: Shared Debt

They saw all the details of my financies when i sent all the information back for the CCJ (the forms said to return the information to them). They can easily see that there is no money.
    strange.

      Re: Shared Debt

Just had a communcation from the local court saying i have a re-determination in May.

Pretty pointless from what i can see, i have multiple creditors all after money i don't have

They haven't said anything about :-
      a) if i have to be there?
      b) what i need to bring with me ?

Why is there presumption that you know what to do????

My other question, is the total debt is 3400, (although 200 of this is made up charges).
If i could persuade my mum to pay this off for me (possibly), what should i offer. and should i do it now, or after re-determination.
no payments have been made in 7 months. (apart from the £1 the CCJ said to pay this month).

      thanks

        Re: Shared Debt

if you're not paying, have no assets and don't care about the ccj - then why are you even bothering with it?

I mean, nothing paid to it in 7 months, why not wait another 5 years and it'll be as good as SB

You do not have to attend any redetermination...

          Re: Shared Debt

Ok.. so no need to attend good. saves booking time off work that i don't have.

Will they use the original information that the northampton place used (the forms i filled in), or should i send more paperwork to the local court? (showing my incomings and outgoings?)

Well this is the one with the CCJ (£1 a month), which i have paid for feb. So it will stay with me for 286 years. (apologies if this was unclear)

Ahh in that case if nothing has changed then fill it in with same details.

If I was you I would contact the court to ask what they want you to do or supply for the hearing.

                  Re: Shared Debt

Ok, i wrote to the court and asked them what i needed to bring. the answer was basically proof of expenditure.

I've been reading up a bit, and it seems that Sygma Bank may be going down this route, as a precussor to a charging order.

am i correct in thinking that cannot happen at this meeting with the judge, and that has to be a separate process. ?

This whole idea, of companies lending unsecured loans, then, through the courts, being able to turn them into secured loans is mind boggling.

                    Welcome to the club.

Think when it happens to us all we cant quite get our head round it. Should have a warning like secured debt.

But the public merrily carry on spending leaving themselves wide open to one life event sending them down the route you are travelling and many before you already have.

ok so had the court appearance today.

End result is the judge decided the money payable was ''forthwith''

what can this debtor do now to me ? - (all options).?

                        Re: Shared Debt

Suspect as post 13 says they are after the CO. Seems the obvious route to take to enforce it.

If you are struggling to pay £1 a month you aint got a cat in hells chance in paying the whole lot in one go.

You didnt allude to the date of your CCJ. Pre or post 1/10/2012.? If pre that date makes even more sense.

                          Re: Shared Debt

I think the option may still be open to either come to an instalment arrangement directly with the creditor or appeal the decision within a certain timeframe.

I'll flag this up for more help..

                            Re: Shared Debt

Yes, i am a bit puzzled as to what happens now, the solicitor? representing one credit card, who i have the CCJ just said ''other means of recovering the debt''.

also,,, now that i have the CCJ. can i do anything with this regarding the total, or has that ship sailed.

                              Re: Shared Debt

If they have changed it to forthwith from £1, the likelihood is that they will go for a CO.

If the property is jointly owned, then they can only register a restriction, not a full charging order.

If you mean by the total, can you negotiate a lower settlement, then all things are possible. Do you have a sum to offer?

With regard to making an offer..

lets say i had 6 creditors, and i had 20k..

Would i offer each of them the same percentage of the 20k that i had. and if only 4 of the 6 accept.. accept just those 4 ?
