    CCA request sent 15/09/22 signed for by CABOT, that was the signed name, not an individual.
    Arvato letters sent april 2022
    Cabot started letters 09/06/22
    Mortimer Clark letter 07/10/22, asking for income status and county court threats.
    County Court N1 11/11/22, plus £140 in costs, court fee and legal fees

    Cabot has referred debt to Mortimer Clark Solicitors, I sent a CCA request on the 14th of September to Cabot - no response as of 12/10/2022
    Q. Do I send another CCA request to MCS?

      Did you send the request recorded delivery, and if so does it show as delivered on the Royal Mail website? Do not send another to MCS.

        Yes I sent the CCA request signed for, but they never replied, I have researched both cabot and MCS, on companies house, the director is the same person and the same address I sent the CCA to. So I don't why they never replied.

        I just checked royalmail, and the letter was received and signed for by cabot on the 15th of september.

          OK, so they are just reaching the time by which they ought to have complied with your request. The account is unenforceable until they do produce a compliant agreement.

          Sit on your hands now. Do not give them another opportunity. Report here when you hear from MC.

            FWIW I sent six requests for CCAs, and received replies for only three. You've done your bit by asking for them, it's now up to the parasites to do their part and produce them. As SW says, bide your time & report back if & when you hear anything.

                If it helps calm your nerves have a read of https://www.handbook.fca.org.uk/handbook/CONC/13/1.html
                In essence it says what has been said above but also more details- if a firm know they have not replied they should tell you it is UE but I suspect many firms 'lose' the letter.

                However as I think Roger was asking

                Can you evidence you sent the request ( maybe proof of posting or signed for receipt) and proof you sent payment - maybe a P.O. receipt or cheque stub. If the answer is yes to both keep them safe

                    I have recieved the County Court paperwork 15/11/22, dated 11/11/22, Cabot have not replied to my CCA request, and I am looking at the N244 form to set aside, is this the best method? I am also a student and none of the forms offer that tick box.

                              Please can someone advise whats the best thing to do? I want to dispute the claim and tick that box, for defence i'm thinking of this - The Claimant has not replied to the CCA request, and I have the evidence of the signed delivery at Cabot Financial on 15th of September 2022.
                              Is the above enough information?

                              I am a student of Criminology, and it is these aspects of stress caused by corporations, that shorten life expectancy. The covid pandemic was the reason for the debts I incured, and this is the first of 5. Also it is AI that has changed many working environments, and I have been a victim of that.
                              I don't believe that the Government, its agencies and the enitities they defend, truly understand that AI has a direct effect on the human being.
                              For example, the letters that we recieve from the credit agencies, are not written by an individual, a computer is programmed to send the correspondance out at certain times and with use of algorithms, they would be sent at a most vulnerable time to that individual.
