      Hi Di,

This account was opened in 2006 by post I believe, I got a form through my letter box and I sent it off.
I am sure I received a default notice earlier this year but I haven't managed to find it yet.
I had phoned Capital One to try and get 'back on track' as I had missed payments and agreed to pay 150 a month for 4 months, think I managed 3 months and then thought 'sod it'.
The account hasn't been terminated as yet, I have been receiving letters and emails requesting payment
Hopefully Capital 1 will terminate the account soon and then assign/sell the debt since you have just stopped paying, but they can be slow to do that.

You can send them a s77-79 CCA Request now, but perhaps wait unless they threaten anything serious.

      Di

I have just realised the letter I received from Capital One was a Notice of Sums in Arrears rather than a default notice, I am assuming they are 2 different things altogether.
I have received several of these letters from different creditors now.

I'm guessing you've received a Notice of Default Sums detailing any money you have to pay for defaulting on a payment etc. Does the Notice refer to a £12 charge?

A Notice of Sums in Arrears is different > http://www.legislation.gov.uk/ukpga/...d-default-sums

If you've received letters from your creditors then update your Diary posts for each debt to keep track of their history which helps members to make suggestions as to your next step in each case.

            Di

I notice this post has been overlooked so maybe post an update on the situation to see what's needed.

How much was the original PDL advance?

The FCA made it clear (when introducing a price cap) that a borrower cannot be charged more than twice what they borrowed > https://www.fca.org.uk/news/press-re...payday-lenders

Have you heard anything more from SLL?

You say you've not made any payments to Sunny ever, so this may mean there are/were affordability issues to explore. Sunny are well aware of these problems as explained here > https://debtcamel.co.uk/sunny-payday...ation-unclear/
