    You have no right to complain mate? Why would you do this and waste both your own and their time?

    No wonder they have a backlog on proper cases when people complain over things they have no right to complain over. You missed the payment mate, even if there was a war you would still be expected to pay! You agreed to - you knew it was due - so no excuse mate, you should have paid!

    Also, in all the N Brown group terms it says that you are liable to check your account standing online at regular intervals.

    Mate sorry but you're wrong here, nothing you can do other than to "ask" the data Controller to review the data - however I can tell you now they will refuse, and rightly so.

          Have you sent the SAR for cifas? It may be worth doing it anyway, just to see?

          Well done on passing tenancy, however bear in mind they do not credit score the same as a bank lol. They only check for fraud, huge non payment and general stability.... they cannot and will not refuse you just cos you're a few payments behind or have the odd default.

            Mate, you were spot on. All the client can do is add a NoC and ask the controller to review the data entry. That is, unfortunately all he can do..... usually the lender say no, which is their prerogative....

                well, we shall see what happens. If you had a direct debit going out for something without seeing what you were paying for first would you still let it go?

                  I will SAR them, just not sure what is going on. Last time I had CIFAS (2005) I had about 30 of them, all visible on my credit file, this time...none (visible at least - as I know you said some are not visible on credit reports).

                    I wouldn't allow a direct debit to leave unless I knew it was there, ie if you had a DD set up then that's protected under the DD Guarantee so yea - i'd be more than happy mate.

                      Wizz, one good thing about a SAR is that it throws up all sorts of stuff that you may find useful for expanding your complaint. So good idea and lets hope there's plenty there for Wizzy's Revenge!

                          Don’t take it personally wizzy. The ICO are overloaded with complaints. Niddy is helping people defend court actions and very serious debt problems and unfortunately due ICO backlog they are waiting months for a reply.

                          I understand that your problem is frustrating however its not critical in comparison to someone facing bankruptcy or losing their home. Put yourself in their shoes and think of the worry these people have got hanging over their heads.

                                Gerry, well said - exactly how it is

                                It frustrates me that court cases are being stayed and we can't go for the kill as the lenders KNOW about their delays so they think they can force through a court case, which are they doing, knowing we need the SAR and the ICO cannot ask them to provide it, until they get the case which lately is taking 60 days upwards!
