    Wizz, one good thing about a SAR is that it throws up all sorts of stuff that you may find useful for expanding your complaint. So good idea and lets hope there's plenty there for Wizzy's Revenge!

    I wouldn't allow a direct debit to leave unless I knew it was there, ie if you had a DD set up then that's protected under the DD Guarantee so yea - i'd be more than happy mate.

    Well done on passing tenancy, however bear in mind they do not credit score the same as a bank lol. They only check for fraud, huge non payment and general stability.... they cannot and will not refuse you just cos you're a few payments behind or have the odd default.
    I will SAR them, just not sure what is going on. Last time I had CIFAS (2005) I had about 30 of them, all visible on my credit file, this time...none (visible at least - as I know you said some are not visible on credit reports).

    No wonder they have a backlog on proper cases when people complain over things they have no right to complain over. You missed the payment mate, even if there was a war you would still be expected to pay! You agreed to - you knew it was due - so no excuse mate, you should have paid!

    Also, in all the N Brown group terms it says that you are liable to check your account standing online at regular intervals.

    Mate sorry but you're wrong here, nothing you can do other than to "ask" the data Controller to review the data - however I can tell you now they will refuse, and rightly so.
    well, we shall see what happens. If you had a direct debit going out for something without seeing what you were paying for first would you still let it go?

    Mate, you were spot on. All the client can do is add a NoC and ask the controller to review the data entry. That is, unfortunately all he can do..... usually the lender say no, which is their prerogative....

    Have you sent the SAR for cifas? It may be worth doing it anyway, just to see?

    I dont think I have any at all mate as I passed the check for the tenancy with no problems at all. I think it may be because he used the old application data from 2005 when I was declined due to CIFAS!? Their systems may have seen a CIFAS from then, who knows!

    I have also complained to Nationwide about this....I want them to speak to their Experian team and find out what the situation is!

    But, the client did agree to the terms of the account and therefore knew a payment was due, failure to receive statement does not qualify for an excuse! In a nutshell, I am 100% confident that Debt Star is actually right this time lol.

    Basically, there is nothing he can do other than to ask, and try appealing to the original creditor. The DPA does not come into this as the Data Controller (N Brown Group) did report factual data to the Data Processor (CRA's) about the Data Subject (customer).

    Those are the 3 strings of processing under the DPA. There are no others.....

    Data Subject = Customer - the customer authorises the Data Controller (the company) to share his data with the Data Processor (the CRA's).... therefore if the subject missed a payment then the controller has every right to report this to the processor.

    Make sense?
