So in theory, as this is all based upon contractual law, you could simply state that it was driven by a mate on that day and they've now left the area.... preventing them from forming a contract with anyone.

No, because POFA requires that if the RK alleges someone else is driving, in order to place liability on that driver, they must supply a name and current service address. Failing that the PPC can chase the RK.

There will be no adverse effect on the credit record until such times as they issue a court claim, win and the judgment is not paid within 28 days. Only then is the CCJ recorded against the credit file

My ONLY concern is if anything should make its way to her credit file at some point down the track..... as she'll be looking to buy a property in the next year or so. If it comes to it, I'll say it's me, since I don't give a rate arse about my credit file anyway....

Only just received a letter re. this. They've now traced my daughter through DVLA records and want her to divulge the name of the driver under the Protection of Freedoms Act 2012. As "we do not know the name and current address of the driver", then under Schedule 4 of this Act, she is apparently required to do one of the following:

Pay it
Give up the driver details if it's not her
Appeal

If this is not done in 28 days, then.... poof..... she will have morphed into the driver and will be liable.

I am so tempted to write and tell them to feck off.... but seem to think I should ignore it for now....

Did you try going on their website and inputting your ticket number. I did this to see if they had a photograph of their opinion of my ticket not being on display enough and it is still not on their system (ticket was from the 1st November) I think I'll just ignore it.

My daughter tried to get on their website before speaking to me.... but it didn't recognise the ticket number or something, so it sounds similar to what you're saying.

I've told her to ignore it.... there's no way I'm paying that....

If I hear anything though, I'll post it on here....

Hi P1,

If I were you I would ignore it completely. You get a couple of chase letters from the parking company, one or two from a 'DCA' then a so-called solicitor's letter. If you've been on this forum as long as I think you have you could be well familiar with these types of letters. These companies rarely bother to go to court. I understand in 2011 out of all these only 49 went to court and they won less than half. Those they won are suspected to be default judgements.

If it's from a private parking company it's not a fine, but a 'speculative invoice'.

Take a look at what is likely to be coming through the letter box over the next few weeks.

I had one of these in May. I completely ignored it, and the follow on threat-o-grams. Nothing has happened so far.

If it helps there's a thread on MSE which gives examples of the template letters they'll probably send as they escalate their threats, from demand for the full charge, through DCA to legal threat. Just look this up and they're listed by company. It can be fun playing Snap with the letters until you get the rest of the set!

None of my daughter's uni friends have had any follow up..... not to her knowledge anyway. If it comes to it, I'll say I was driving and take it from there.... but will ignore until/unless they pass it on to a DCA

Hi,
I got a similar ticket this morning at my flat car parking spot (well 00:30 last night). Fined the same amount for 'permit not clearly displayed'. They sent out a new parking permit to use from 1st November which I had displayed. However I did not realise the black tint line of my windscreen was blocking the very bottom.
I am interested to find out if you had any updates with the ticket?

be a total waste of time sending ANY correspondance to those scumbags....every single "appeal" you lodge will always fail no matter what

best to just ride the letters out and ignore everything they send

Yep 1st october clamping now supposedly ceased....

but as far as your daughters ticket is concerned they can do F*!**! all thats for sure...you can count on less than one hand the number that end in court..and all those past cases always win kicking the parking firms out as a joke....just ignore ALL letters and shell be fine

Other students have also said similar to her....
