    • Date loan taken out - 08/08/2014

    • Date a payment was last made - No payment made

    • Status (i.e. did you discuss a payment arrangement or just stop paying)? - Stopped paying.

    • When applying for the loan did you have to fill out an application form and do you have a copy? - I don't have an original application form copy, online application.

    • During the application for the loan were you given any pre-contact information or fact sheet so you could assess the affordability of the loan that was being offered to you and do you have a copy? - Yes, these are now attached.

    • Were you given a credit agreement and if so do you have a copy? - If thats a SECCI then yes.

    • Did you ever roll over the loan and if so how many times? - Never rolled over the loan.

    • If you rolled over the it would be helpful to understand the following - the amount of money you have repaid in total compared to the capital lent?- N/A

    • If you rolled over the loan were you provided new pre-contract information and new credit agreement each time and if so do you have copies? - N/A

    • Did you receive any arrears notice/letter also containing information on where you can go to get advice on your debts? - I'm sure I did but don't have any copies.

    • Have you received any sort of default or termination notice to your POSTAL address? - I cannot be 100%, but I can kind of remember that I received a default notice.

    • When was the last time you sent any correspondence to them (either by email or post)? - 13th October.

    I received an email from PlanDeal advising UncleBuck recalled the debt from them and that was the last I heard of it, and that was on 18/04/2015.

    The above SECCI has had nothing ommitted, so where it says creditors address etc I haven't blanked it out.

    This is the email I received from PlanDeal:-

          BTW - I've removed the attachments from your post as they had personal information in them, plus I got my answer to the above - orginal loan was for £200.

              I've had a quick look, and unusually (and unfortunately), they have played by the rules at the time (and also the new rules that were introduced on Jan 6th this year).

              An only angle I can see initially is that the APR you signed up for was an eye-watering 52,553%, which may give you an argument on the unfair relationship provisions.

              What they will come back with though, is that they provided the pre-contract info so you would know what you were signing yourself up for.

              What is the breakdown of the £472.60?.

              The only other argument you may have is that the new rules brought in by the FCA governing payday loan this year state that no debt should be more than double the principle amount lent.

                I'll be back this evening, I want to read through the FCA guidance again, as it may provide you with a defence, to at the least, reduce the amount claimed to the principal sum.
