    NIDDY - We received our CCA from another account today, which I've emailed to you. I can't believe the length of these things!! Thank you so much for taking the time to look these over for us!

    I'm just beating my head against a wall right now with Santander and our overdraft. (I know it doesn't qualify for UE, just moaning LOL) We had an agreement for the last 6 months - I pay £50 per month and they stop all interest, fees, and charges. I paid it religiously by standing order for the entire time. I received a letter on 10 Sept (dated 02 Sept) saying thanks for sticking to our payment agreement, that agreement is now done - please pay the entire amount (just under £2000!) within 7 days. Then I sent off a letter to them (on 11 Sept, wasted no time!) requesting that the previous agreement continue. Yesterday I received two letters from them - one is dated 11 Sept saying it's a notice of intent to send default info, and one dated 10 Sept which is actual default notice. Too aggravated to even think straight on this one at the moment!! It says "and pending charges" which means that now that I've FINALLY got it under the £2000 limit (JUST!!), they're going to slam me with interest and charges - which will then take us over the overdraft limit - and then they'll add ANOTHER £60 per month for being over - due to the stupid charges!!! And it will effectively eat up everything I've paid over the last 6 months in one hit! Unfortunately, I think I am going to have to ring them on Monday as I cannot face being put right back where I was 6 months ago!! It's so maddening!! How in God's name do they expect people to pay these things off?!?!?!

    Hiya, glad that your son is ok - nightmare situation if he'd got free so to speak!

    Regards to MBNA - ignore them, they have issued a final response so fine, leave them to sweat - no reply necessary ok?

    He is. He's just turned 4 and just started reception. Managed to simply walk out an insecure gate on the playground and into the carpark during playtime. Teacher blamed him, I blamed lack of both supervision and a padlock on the gate. Sorted in the end, but it involved meetings with teacher and headteacher and such. Headteacher was good about it and has sorted a lock on the gate now, so problem solved. But it was a bit chaotic there - hard enough to take little ones to school, but couldn't deal with worrying he'd get lost or hurt while there!

    Anyway......
    Got a letter from DCA handling the MBNA account (that is UE as listed above). Basically saying "concerned that you have ignored our letters" (they've sent 1 previous that I ignored - the one saying it's enforceable, when it really isn't!) and "this debt won't just go away" and such. Is there some type of final "look quit bothering me, it really IS unenforceable" letter to send to them? (such as viewtopic.php?p=2309#p2309 ?) Their last letter said it was the "last time they would discuss the CCA" basically, which is a bit like sticking their fingers in their ears and claiming "lalalala I'm not listening!"

    Oh, okay, I see. Sorry, things have been insane here lately - 4yo started reception the other day and we had a major incident at the school, and I'm ever so scattered right now. Will pull my brain together now and get moving on these letters. Thanks so much NIDDY.

    Yep, course it is in dispute - unless you admit that you wanted PPi and agree to pay it...?

    Sent the letter as advised and also work with this; to reclaim PPi (direct from lender).... viewtopic.php?f=42&t=53

    They're not in dispute any longer though, are they? - they sent the CCA and you said it was enforceable. Confused. Does that mean I now push the PPI thing? I would imagine the PPI would be about what the balance is.

    I am sorry, this stuff is making my head hurt. Santander has made this so difficult to wade through - I just hate getting post from them. Seems like every letter is designed to either upset or confuse - I suppose so that you'll ring them instead of writing. *sigh*

    Send nothing to Abbey - the arrears thing doesn't matter, a small typo does not change the legal affect/standing of a debt....

I'm a bit unsure where to go on this, and would like some input from you when you have time to look it over. It's pretty brief, but the whole "Arrears £00.00" rather makes me wonder whether or not I should simply copy that letter, send it to the DCA and say "what arrears? They're saying here that there ARE no arrears."

    Brief overall tally (for my own benefit to keep track):

    Additions - :UE

    MBNA Santander - :UE

    Tesco loan - sending letter to them on Monday (as recommended by NIDDY) as still wrangling over signature, technically in default re the CCA.

    Santander loan - already checked by NIDDY, was preparing to reclaim PPI (as was mis-sold), however, they've sent us a letter saying Arrears £00.00. I may hold off just a bit on this to see where they are going with it. I can still prepare the PPI letter and have it ready. ;Hmm

    Virgin MBNA - still on hold with DCA, awaiting CCA response, technically in default re the CCA.

    Halifax - still on hold with DCA, awaiting CCA response, technically in default re the CCA.

    Santander - have written to us stating outstanding balance is £0.

    Paypal Santander - already checked by NIDDY, are making monthly reduced payments, which they seem fine with.

    So all in all, things are moving along well. It's a bit easier to deal with now that different accounts are sitting at different stages. But we'll be glad when it's all taken care of.... a long haul, but we didn't get into this situation overnight, so don't expect it to be sorted overnight either.

    MBNA - ignore them, its finished and :UE

    Additions - they will default you and are allowed to in line with McGuffick v RBS so nothing to do there, just ignore things - it is the final process prior to account termination. ;30
