Re: liandconsmum's UE Diary
oh poo... that's wretched... I will look into the PPI on it. I looked through it, and it looks like it was mis-sold -no mention of pre-existing medical conditions for starters, which DH has. I also noted that from pg10-14, those must be CURRENT T&C, as the printed address is our current address, and we were living at a different address when this account was started. Thanks. Will follow up with the PPI. Do I need to do a SAR on it, or just request refund in general?

Re: liandconsmum's UE Diary
Oooer, you've been stung with the old tick-in-the-box.... it is enforceable, sorry!Originally posted by liandconsmumI've emailed you the CCA we received this morning from Virgin. My guess is UE, but god knows if that is correct. I sent it in two emails, as it was quite long, marked Part 1 of 2, and Part 2 of 2. Hope it all goes through okay! Thank you for all your help on this stuff!!
See page 4 - this clearly shows it was applied for online and has the corresponding tick. Regards to the tick-in-the-box - read this: ---> http://www.legislation.gov.uk/uksi/2004 ... tents/made
Basically, for agreements made online after December 2004, the Consumer Credit (Electronic Communications) Order 2004 allows the signature in the signature box to be replaced by a tick box.
This account was taken with PPi - are you aware of that? Could be worth a reclaim....

Re: liandconsmum's UE Diary
LOL that's okay. I thought I'd done something to the settings on my computer - so that's a relief.

Re: liandconsmum's UE diary
Stick with it, time to compile a complaint to the ico..... If you already sent that letter just complain and don't send it again.Originally posted by liandconsmumNIDDY - that's the one I sent to Tesco last time (this is their 3rd letter saying they need a signature now).

Re: liandconsmum's UE diary
Hmmm... won't let me edit my posts now for some reason... tried to edit and it looks like it just posted it again. Weird. Now don't see a button to edit the post at all.
Anyway, for my own "keeping track" purposes:
Tesco loan - still wrangling over them wanting a signature, currently UE as no CCA received yet and in default
Santander loan - awaiting request for reimbursement of mis-sold PPI
Virgin MBNA - awaiting response from CCA request, currently UE as no CCA received yet and in default
Additions - :UE
Halifax/Yahoo - :UE , sending letter recommended
Santander - Showing £0 balance
Paypal Santander - enforceable, making regular payments
MBNA Santander - :UE

Niddy - thanks so much! I have put together that letter for the Yahoo/Halifax card and will get it sent. I've just emailed you the response that I got from Tesco today - yet again "no signature - no CCA" basically.
And thank you for the advice on the overdraft. Just waiting to see what develops on that one.
but hey... I'm calm now.... lol

Hiya, this is relating to HBOS - the credit card agreement they sent right? Yahoo credit card...?Originally posted by liandconsmumNIDDY - We received our CCA from another account today, which I've emailed to you. I can't believe the length of these things!! Thank you so much for taking the time to look these over for us!
Shame, its a bloody application form with no prescribed terms. Basically, it is :UE
Respond to Moorcroft :-cow (the owners of the account) with this: ---> viewtopic.php?p=1503#p1503
Whoah, back=peddle here - they cannot give you a day to clear an overdraft, they must give you a set period of time to clear the arrears, or the technical term is to "Remedy the Breach" - usually this is 28 days - have a read here and see what you think: ---> viewtopic.php?f=55&t=38Originally posted by liandconsmumI'm just beating my head against a wall right now with Santander and our overdraft. (I know it doesn't qualify for UE, just moaning LOL) We had an agreement for the last 6 months - I pay £50 per month and they stop all interest, fees, and charges. I paid it religiously by standing order for the entire time. I received a letter on 10 Sept (dated 02 Sept) saying thanks for sticking to our payment agreement, that agreement is now done - please pay the entire amount (just under £2000!) within 7 days. Then I sent off a letter to them (on 11 Sept, wasted no time!) requesting that the previous agreement continue. Yesterday I received two letters from them - one is dated 11 Sept saying it's a notice of intent to send default info, and one dated 10 Sept which is actual default notice.
Point here though, if they have defaulted you - stop paying it, sod em! Don't pay - ignore it now for 6yrs and let it become statute barred - just stop banking with them......
An overdraft can be recalled at any time, but stop stressing let them default you, then let them sell it to a DCA and then all you do is ngotiate a F&F with the DCA of around 20-25% of the value meaning you'll make money in the long run instead of paying foreverOriginally posted by liandconsmumToo aggravated to even think straight on this one at the moment!! It says "and pending charges" which means that now that I've FINALLY got it under the £2000 limit (JUST!!), they're going to slam me with interest and charges - which will then take us over the overdraft limit - and then they'll add ANOTHER £60 per month for being over - due to the stupid charges!!! And it will effectively eat up everything I've paid over the last 6 months in one hit!
Unfortunately, I think I am going to have to ring them on Monday as I cannot face being put right back where I was 6 months ago!! It's so maddening!! How in God's name do they expect people to pay these things off?!?!?!
stop stressing and do not ring em monday - let them do what they want, they'll not go for formal action for such a small debt that you have paid and if they do we'll get it set aside for incorrect useage of s.87 & s.88 by way of issuing an unlawful default notice
You should know me, answer for everything - now calm down ok? :xmas9Last edited by diddlydee; 28 June 2013, 18:04.
