    Try not to be nervous, we will not abandon you and you will get replies - sometimes you may have to remind us as we have other things to deal with! As jlc has posted, it is a game and it's great when you look forward to the post for the next move.

      It is great news about it being unenforceable - just need to know that you will be with me all the way. My husband is really calm about all this - he says that the difference is he isn't frightened about these people and I am. Hope you don't mind me posting my fears - hubby sometimes doesn't get how worried I am.

      Please don't worry, though I remember I was terrified at first. DCAs etc play on your fear, that's why they write in big red capitals and tell you what "may" happen (though of course you don't realise that it is only "may" as you only read the words court, charging order etc and go into a panic!) We won't abandon you though, as Cym says, we might need a gentle nudge sometimes.

      There are many of us on here approaching the 6 year anniversary when the debts will be statute barred, myself included. If I can do it anyone can! x

        There have been a few who thought we wouldn't last or tried to get us closed down. 6 years later we're stronger and more successful than anyone ever gave us credit for.

        We love rubbing their noses in it (as we've now left them lingering behind - jealous of us and our lovely members).

            Morning everyone

            Sorry to ask questions again - but would you be able to settle my still worried mind. I do feel better than I did and have read some of the diaries which have made me chuckle.

            I'm getting in a tiz about CCJ's. I know hubby's agreement is unenforceable, but would that stop them having a go? I'm bricking it re a Charging order you see. Also, the letter we got was sent to his old address, luckily where his mum lives, but does he need to let them know he has moved - I'm bothered about missing anything but there again as it is his mum's house am I worrying unnecessarily?

            Lastly, would Niddy check another agreement. This one I think is about 7 weeks away from becoming SB. It would be a weight off my mind.

              Hi , someone will be along to answer your questions. SB starts one month after last payment I.e if your last payment was 6 yrs ago in June 1st missed payment would be July , so SB 6 yrs from the July, hope that makes sense .Unless someone knoiws better xxx You are not pestering you don't know so always ask .xxxx
              if you do it today and you like it you can always do it again tomorrow

                You should start a diary and put all your debts on it. From what I understand, if the debt is unenforceable, they wouldn't be able to make it stand up in court so it puts You in control. Reading in here, if you do get a threat of Action, they will help you through it with the help of their legal team.

                  Hi, try not to worry!!!!! Re unenforceable agreements, yes they can take you to court BUT we have a very successful legal team and links with an excellent solicitor who specialise in the CCA and in beating DCAs. When an agreement is unenforceable and the defence is submitted, the majority of claims supported by AAD are discontinued before court.
                  This is a long way down the road for you, just remember to ask for help before you reply to any communications, so that you follow the route that we use with our very carefully worded letters.
                  Charging orders cannot be obtained until you have lost at court - all this is a long way down the road and you will be supported to avoid this.

                  You can send any unedited agreements to Niddy with a link to a relevant thread and your name.

                    If you aren't homeowners they can't touch your mums house!!!! I'm sure anything comes, she'll tell him!

                      We are homeowners - the letter was sent to his old address where his mum lives. Sorry - I know I must be coming across as a complete spanner about this. Need to give myself a kick up the arse with some fighting spirit.

                        Eh?

                        Is it YOUR house or is it his mums house? You're saying you're worried but then you're saying its his mums house. Why would you worry about another persons property?

                          Just relax and join me (I'm just starting as well) on this journey. I had the same worries (read my diary). I have £200k equity in my home and my husband is going to pay the rest off soon. It worries me, but decided I would cross that bridge when it came. It's unenforceable and no matter how horrible sounding the letters are, they will have trouble taking it to court. If you join AAD+, you will be able to read something about the court cases that they have helped defend. Believe me, I am both excited and worried, but playing this 'game' is going to be fun. Just remember that the DCAs paid peanuts for your debt and the bank wrote it off. The more I read about the banks and DVAs, the more I realise that I don't owe them anything!

                            We live in our own house. The letter which was sent to my husband was sent to his previous address which is where his mum lives and is her property. And yes you are absolutely right - if she gets another letter for him, I'm sure she will tell us.

                                Right - so your answer is they can't touch your mums house. Just ask her to let you know when mail comes. I'd not be worrying. I'd also not be telling them your new address.

                                Its a bit like asking me "if bailiffs come can they take my sons car"... No. As it isn't yours! Same thing.
