    Don't worry about that yet, first thing - lets get rossendales off the case.

    Worry about cca breaches later, as right now they cannot enforce so long as that breach remains

    Thanks everyone I nearly managed to get a decent nights sleep last night. Hopefully no more of these will appear out of the woodwork now. They always seem to just around Christmas to make life even worse

    Hiya

    Ok, having looked at this and with the clear lack of knowledge involved it would be best if right now you simply started again and at this stage write to them asking them to write off the debt.

    I'm not trying to get you to go backwards, but by formalising it we then have something to fall back on should they refuse and/or not do things as asked, and within the scope of current legislation and guidance.

    Hence, for now send this to Rossendales (regards MBNA)..

    ---> Our Templates | General Debt Templates | Ask your Creditor to Write off your Debt

    Send the above, with your added extra's included, and let me know upon any response - this is formalising things so they have to take notice, or we'll then look at complaining to the regulators. Before posting it, please email me a copy of it after you've filled in the blanks (your illness/reasons) and I'll check it over....

    It was passed around various debt collectors, those are all the letters I have the last time I wrote back to Arrow was in response to a letter off them in February 2011 stating that I couldn't pay any creditors and about my ill health and asking to write it off. Then didnt hear anything until the letter off Rossendales a couple of weeks ago. I first contacted MBNA in January 2006 stating I couldnt pay, then the merrygoround started. They eventually offered to settle for £600 before passing the debt on, this was by telephone, before I had a vague clue about what I was doing. I have found some more letters and have emailed them to you. I have also sent the letters I sent to them.

    I have noticed the letters have different amounts and I was only sent the application form I filled out

    Now trying to be orgainsed and keep things together

    I havent sent my reply to them today I will wait for your repsonse

    Yea rossendales are dca's as well as bailiffs but don't worry.

    I'll sort you a suitable response later. For now ignore them. No more writing letters as you may be affecting SB dependant on wording used.

    Be VERY careful when sending letters at this stage, even if they are well intentioned. You only have to acknowledge the alleged debt in writing and those four years will be wiped out.

    DROSSendales are bailiffs, aren't they? How did they come to get involved in this? It might be a good idea to give us a full history of what has happened so far, insofar as you can.
