    Account #1

    HSBC Overdraft

    Type of account: Current account
    Date account opened: c. 1987
    Approx. balance: £900
Date last paid: 1st Dec 2017
Arrangement: £1 monthly + £2 from unknown origin (more on that below)
    Status: default
Account Owner: Marlin Europe I Limited
Correspondence coming from: Cabot Financial (Europe) Ltd

    Notes:

Not being charged interest or other charges
Letters so far not aggressive or threatening, but ignoring one usually means another one a couple of weeks later

    Timeline:

2005: was on an IVA for this and other debts

2006: IVA failed because I couldn’t keep up repayments, all debts sold on, this overdraft passed on to Metropolitan Collection Services who was collecting on behalf of HSBC.

2011: Due to low income, I qualified for legal assistance from Community Legal Advice (Now Shelter) who wrote on my behalf to all creditors including this one, and negotiated the arrangement I have been on ever since.

2011: Debt passed on to Capquest.

2014: Overdraft sold on to Marlin Europe I Limited. Informed by letter from HSBC.

2016: Correspondence starts to come from Cabot Financial (Europe) Ltd.

Oct 2017: Letter from Cabot asking if I can pay ‘the other £2’ directly to them. No idea about this other payment as not making it myself. Had not been paying attention to statements up to this point but upon checking can see extra payments coming off the balance.

Oct 2017: Replied with generic ‘can we keep to current arrangement’. Also mentioned the reality that if current repayment not satisfactory I will go bankrupt as I have no assets or savings and am on low income.

Oct 2017: Reply from Cabot ‘please fill in income/expenditure’ we just want to make sure you can afford the repayment.

Oct 2017: Replied saying yes I can afford it, didn’t fill the form.

30 Nov 2017: Another letter from Cabot saying ‘Time for a review, account was on hold, if there’s any way we can help, etc’.

5 Dec 2017: sent a letter back to Cabot saying ‘situation still the same, please can we keep to current arrangement’.
