    Ideally keep a diary for each of your accounts all on just one thread. You have headed this thread PRA, but no real reason not to include any other would-be creditor here as well. Just start a diary for this one here.

    On a different matter - please let me know if I need to start another thread for this. But Mortimer Clark have started pestering me for payment of an old (2009) Lloyds loan. They (MC) have a re-constituted credit agreement - with a wrong address on it. Plus, the loan was taken out to pay off Lloyds credit card. Credit card agreement is unenforceable. Any thoughts?

    His advice is to sit tight, not send the form that came with LBA, as this may allow PRA to get more information together.
    This is exactly the process I went through, sit tight, it will all out in the wash...

    So, a belated update - spoke to Gerry from Joanna Connolly Solicitors. His advice is to sit tight, not send the form that came with LBA, as this may allow PRA to get more information together. In all likelihood, the next thing that’ll happen will be papers from Northampton Court. Will update when anything happens

    PRA have possible Assignment issues over previous Aktiv debts!

    At this moment I think you should Contact Colin G Quinn before replying to that Letter before Claim

    Also - I have only just noticed, but the letter of claim refers to outstanding balance of a lot higher than their most recent statement. so I guess a full statement of account will be needed to be provided by PRA?

    It’s a Lloyds credit card, taken out in 2009. Yes, I did SAR Lloyds and have all the info from them. I also have a copy of notice of assignment to Aktiv, but it didn’t come from Lloyds.

    Which account is this, and have you ever sent a SAR to the original owner of the debt? Payplan are not going to have the crucial original documents.

    There have been other emails / letters from PRA in the month of August. All the same begging ones, to contact them to resolve the payment issue as they’d rather not go to court. And then last week a Letter Before Action landed. I’m to respond by 22nd of September. Although a follow-up email says 17 September. Gonna go with the date on the letter. Am I right in assuming that it’s best to send the LBA to PRA as close to 22 September as possible? And do I tick a box D (dispute this debt) and box I, asking for everything on the list in box I, plus deeds of assignment and notices of assignment?
    SAR was requested from Payplan on 18th August, so should come through shortly, but possibly not before I have to return the forms.

    I've had lots of comminications from various companies like this. All they are doing is slipping the word court in to try and intimidate you into paying. It's a big thing to you but remember they will have a big portfolio of debts and an automated system that sends out various things from their threat list as it's cheaper and easier than taking any action against you. Just keep quiet unless they actually say they are taking action and then come back here for advice.

    I've been where you are. Any communication I used to panic. Now that I am a little bit better informed, it is water off a ducks back. Don't forget they are trying to intimidate you into paying. Resist at all costs.
