Didn't you tick the box for mediation on your Directions Questionnaire? Or maybe you did and the Claimant refused

Hi, you could try contacting one of the Mods by private mail - I see that Mrs D, If and Deepie are all online at the moment. They may be able to contact Andrew.

Let me help you with that on your other thread in the Housing section. Update it and we'll take it from there

After all if you've sold the property they can't place a charging order on it can they

With both BTL flats sold would that leave your own home vulnerable to a CO if the buggers get a CCJ against you first? I can't remember if you own that too or are renting. I think you own it with mortgage from a different bank or is it with NatWest who have also issued this claim?

Please complete the acknowledgment of service to indicate that you are going to defend this as that automatically gets you another 14 days on top of the 14 you already have. Please then e-mail me the papers at the email address PlanB gave and i will go through them for you. Don't worry they are a long way off getting a charging order yet.

    Re: charging order

your quite correct PlanB that is me! The flats are in my name but are owned by my ex-partner and my mum. I had already offered a f&f which im still waiting to get an answer for!!! The flats are both under offer but I still need to get 1 tenant out, hopefully on the 25th July but I'm not sure she has found anywhere else yet

Ascent don't already have a CCJ on this OD do they? If not I doubt they can get a CO unless there's something different about this because there's a personal guarantee for the business OD involved.

I've remembered that you have a property under offer at the moment. You don't want this to scupper that sale. When the sale goes through would you have enough leftover to pay a F & F if that is the only way forward? Both those flats have plenty of equity.

This is an OD which your business partner thinks is already paid off isn't it? And doesn't he also have a financial interest in the properties such as they have BLT mortgages on them in his name (something like that or have I mixed you up with someone else)?
