I've been asking a creditor to supply me with a copy of the deed of assignment. They won't reply. They gave me a Notice of Assignment which had a covering letter was missing. They are saying I can't have it because it contains "priviliged information". Has anyon ever used the following test case and had any luck:- " "Lord Denning states in the Pelias Construction Case (Van Lynn Developments v Pelias Construction Co Ltd 1968 [3] All ER 824) where he said the debtor is entitled to "view the sale agreement to ensure that the assignee can give him good discharge under the contract."
