A new dca will add their name on the file as they are taking over the debt.

thanks Swan, i take that when i recieve a letter from a New DCA, i'll send them a letter telling that the account is in default as they not responded with a CCA then

In answer to your question, as Swanny says, it's been assigned - I did reply to your email as well confirming the same. Sorry, debts don't just vanish - it'll have been assigned to a DCA so expect Cabot et al to appear on your report shortly.... check the default dates match as they try and re-issue one, on occasion.

with reply to your Mail - there is No Text ref: unititled1, it just goes onto the next lender credit file

If i highlight on the box the last recorded info, it says:

Defaulted account Nov 2010
Credit Limit £0
Statement balance£0
payment amount £0

I'll await of any new info to appear.........will update, thanks for e-mailing me

'Red Letter day' recieved today from Wescot: Also updated on #1 of UE

Ref: MBNA account last communication was AIC Dec 2010, No acknowledgement from MBNA that they have sold it to Bank of America (Or is MBNA now owned Bank Of America?)

'Notice of Debt Collection' - Wescot is a specialist DEBT COLLECTION organisation. We have been instructed by their client to collect above outstanding balance on their behalf

update on MBNA (Shows that the client is Bank Of America now)

2nd letter recieved from Westcot today

FINAL NOTICE - Despite previous correspondance, a balance still remains outstanding. Unless contact is made with them and agree payment of within the next 10 days. Collection activity will continue. May lead to:

Either us or client taking legal action against through courts, If legal proceedings are issued and a judgement or a Decree is obtained against you, court fees and legal cost could increase the amount
Reply by 15th September 2011

Looks like that MBNA has sold the account to Bank of America but not told me so........

i do have a CCA copy on the secure content on forum.

Not E-mailed copy of letter to Niddy, but can do so?

Hi 5corpio,

Bank of America owns just about all of MBNAs card operations now en bloc and are about to pull out of Europe (see thread on here) so I would expect an increase in activity from them as they want to sell the business on again en bloc and will want it to look good.

However the Wescot letter is one of their standards we have several and are now ignored. They have had the "bugger-off" specials from me including one to their tame solicitors Nelson Guest and Partners who ran away and returned thre acccount to Wescot when I threatend them with a professional misconduct complaint to the SRA.

I must admit that they have been one of the most persistent but they can be seen off.

20/05/10 - Debt Clear Recoveries (CCA Request)
07/06/10 – Debt Clear Recoveries (CCA Request)
04/12/10 – AIC (Threat-o-Gram)

LETTERS RECIEVED FROM:
25/06/10 – MBNA (original Agreement, Copy of Executed Agreement, Up to date T&C, Recent statement)
10/11/10 – AIC (warning that their letter supersedes all instructions issued by creditors)
24/11/10 – AIC (Threat, Legal Proceedings, Wages, Property, etc)
07/12/10 – AIC (Reviewing File with Collection & Litigation department to consider Warranted)
29/07/11 - MBNA (Confirming previous communication, that the account has been terminated. and that i owe them the debt, they will pass to a select debt agency)
26/08/11 - Wescot (Notice of Debt Collection Bog standard letter, ref their Client Bank of America NOT MBNA)
05/09/11 - Wescot (Final notice, or court proceedings if not contacted or paid)

Yes they have been persistant on another account before, had someone..................... 'EDIT'

just not too sure which letter to send, as/if the account sold whilst in dispute?
