Newbee starting Unenforceability

    Thank you everyone. Here is an update:

    received these letters on 22/02/2012(same day!)
    dated 17/2: Advising of issuing Default shortly
    dated 18/2efault notice served under section 87(1) CCA

    received letter 24/02/2012
    letter dated 20/2/2012: Notifying me of default being registered 28 days from receipt of the letter.

    Is it right for all of these letters to come together???

    Also they have cashed my £1 cheque.

    Do I need to reply to the default notice or sit tight and wait for my info ref UE???

    I am now very confused as to what to do. They are piling on the letters and the phone calls come every 2 weeks.

    Do I keep paying them?????

        • Date commenced (ideally before Apr 2007)

        • Approx balance

        • Date last paid (approximate date you last made a FULL payment)

        • Are you on arrangement or not paying

        • Status (default/in arrears/up-to-date)

        • Account owner (who is writing to you, a DCA or the lender)
        Please see the above and complete the fields for EACH of the 4 accounts you have then we will help - right now we cannot possibly consider offering any support as we're plucking at hairs guessing what you're actually up-to.

          Cheque cashed. Recently I received ther following:

                  eek, they all seem post 2007, not sure theres much that can be done with the UE route. Niddy will confirm.

                    UE isn't an option here I'm afraid. Post 04/07 is s.127 exempt so no right to claim ue.

                        By "UE letter", did you mean your request for the agreement under section 77 (link) or section 78 (link) of the Consumer Credit Act 1974?

                        Did you send either of those by Recorded Delivery?

                          no I didnt send recorde delivery. Will check and post in a minute about the rest!

                          I have already gone into arrangement with them all but I am overstretched. I did the arrangement by myself.

                          Do you think I should contact a DMA and get them to sort?

                          Are there any you would recommend??

                          I just want to get control of everything. But I will say Santander have been a pain They call me every 2 weeks for a grilling. I will refrain from talking to them from now on!!
