    Hello any help would be appreciated please.

    Had a letter today from PRA stating they have been trying to resolve this debt since 17/08/2015 when they purchased this barclaycard account.

    if we don’t get in touch within 30 days they may start court proceedings.


    should we just hold fire or should we respond ? I have no idea if it’s enforceable or not

    Hi Floridajen,

    No need to panic. Does the letter state the age of the alleged agreement (you can usually find that on page 2 or 3).

    If they have had it since 2015 I'm guessing its a quite old account and likely unenforceable. Just remember though, an enforceable agreement is just one part of a claimant's claim. There is a lot more they have to prove and, in the majority of cases, they fail to do so.

        Is this debt on your Diary thread?

        You say you've no idea whether the debt is enforceable or not, does that mean you've not sent a CCA Request in the past.

        Don't do that yet until the full history is clear.

              Is it just a letter or is it a formal 'Letter of Claim' including a Reply form of several pages with Boxes to tick and an Income and Expenditure Form to complete (but you can't be made to!).

              You probably need to explore whether it's enforceable or unenforceable before deciding your next step.

                        It’s just a 1 page letter Di no forms to fill in
                        just saying that they took over in 2015 and have been trying to resolve now I have 30 days before court proceedings may occur

                          Oh that’s good, it is not a letter of claim and if I’ve understood this correctly Niddy has already said this is UE. IF and it is an IF they move on to the next stage and send you a letter of claim, come back and people can help . I have loads of letters saying we may ( note the may , not we will) go to court and 25 didn’t.

                            Ok, it’s just a letter not a formal Letter of Claim so you have time to work out what is best to do.

                            It says proceedings ‘may’ occur not ‘will’ occur.

                            I can see you previously sent a SAR to Barclays for another debt but did you get a response which included documents for this account too?

                            Try not to worry about this tonight, it’s a letter which has landed on your doormat, not a hand grenade.
