    Thanks NW - Sweetie - whatever you do, don't agree to pay anything as if they cannot provide the agreement then they are pretty buggered, as NW has stated in her reply above.

    Sweety, that is great news; as night watch has said they cannot enforce if they cannot supply the CCA, so you don't need to accept their offer to pay anything.

    Just checking whether you've sent the LBA response yet, linked by Nightwatch above, as time is passing.
    The template is listed in the link as "LBA Response Template". If it was me I would send this asap.

    Just received letter off shoesmiths. Stating unless i contact them by phone with 14 days to discuss settlement they will take me to court. They will not contact me to advise me of that. Nationwide will only claim costs if i defend my case

    Unfortunately it's a game of poker where they bluff you to try and intimidate you in to paying. Just because they say they are passing the account to solicitors doesn't mean that they have found anything.

    Just sit back and wait for the next letter; as they haven't produced a CCA, no matter what they threaten they cannot enforce it in court until they produce the agreement.

    Hi sweety,
    Do they say who the solicitor is ?

    your next letter may be from KPR who are an in house debt company of Nationwide, or you may get one from Fredrikson International, I had mine with both of these company's. their letter are worded to frighten you, in the hope you will phone and agree to anything they may suggest.
    As soon as you get anything just post on here and let's see what we can do.
